3     Amendment (with title amendment)
4     Between lines 160 and 161, insert:
5     Section 2.  Subsections (5), (6), and (7) are added to
6section 316.0083, Florida Statutes, to read:
7     316.0083  Mark Wandall Traffic Safety Program;
8administration; report.-
9     (5)  Prior to installing a traffic infraction detector the
10department, a county, or a municipality must request that the
11Department of Transportation perform a safety hazard study for
12the intersection. The department, a county, or a municipality
13shall be responsible for the cost of the study. A traffic
14infraction detector shall not be installed until the Department
15of Transportation has performed the study and determined that
16the intersection warrants a traffic infraction detector.
17     (6)  A safety hazard study required under this section
18shall evaluate the safety of an intersection within a six-month
19period. A safety hazard exists if, at the end of the study
20period, the Department of Transportation identifies a
21statistically disproportionate number of motor vehicle crashes
22at the intersection, greater than that of similarly situated
23intersections in the county or municipality.
24     (7)  Notwithstanding subsection (1), the department, a
25county, or a municipality shall not use a traffic infraction
26detector to issue violations committed by a motor vehicle making
27a right-hand turn.

32     Remove line 9 and insert:
33the act; amending s. 316.0083, F.S. requiring the Department of
34Highway Safety and Motor Vehicles, a municipality or county to
35request the Department of Transportation perform a safety hazard
36study before installing a traffic infraction detector; providing
37for the cost of the study; providing that a traffic infraction
38detector may not be installed unless it is determined to be
39warranted; providing requirements for the safety hazard study;
40providing that traffic infraction detectors may not be used to
41issue certain violations; providing an effective date.
