Florida Senate - 2011 SB 1564 By Senator Fasano 11-00207-11 20111564__ 1 A bill to be entitled 2 An act relating to a special election; providing for a 3 special election to be held on the date of the 4 presidential preference primary in 2012, pursuant to 5 Section 5 of Article XI of the State Constitution, for 6 the approval or rejection by the electors of this 7 state of amendments to the State Constitution, 8 proposed by joint resolution, to prohibit increases in 9 the assessed value of homestead property if the fair 10 market value of the property decreases, reduce the 11 limitation on annual assessment increases applicable 12 to nonhomestead real property, provide an additional 13 homestead exemption for owners of homestead property 14 who have not owned homestead property for a specified 15 time before purchase of the current homestead 16 property, provide application and limitations with 17 respect thereto, and provide an effective date if such 18 amendments are adopted; providing for publication of 19 notice and for procedures; providing an appropriation; 20 providing a contingent effective date. 21 22 Be It Enacted by the Legislature of the State of Florida: 23 24 Section 1. Pursuant to Section 5 of Article XI of the State 25 Constitution, there shall be a special election on the date of 26 the presidential preference primary, which shall be held 27 concurrently with other statewide elections held on that date, 28 if any, at which there shall be submitted to the electors of 29 this state for approval or rejection the amendments to the State 30 Constitution proposed in Senate Joint Resolution 658 or House 31 Joint Resolution 381. 32 Section 2. Publication of notice shall be in accordance 33 with Section 5 of Article XI of the State Constitution. The 34 special election shall be held as other special elections are 35 held. 36 Section 3. The sum of $560,000 in nonrecurring funds from 37 the General Revenue Fund is appropriated to the Department of 38 State for the 2011-2012 fiscal year for the purpose of 39 advertising the constitutional amendments being submitted to the 40 electors of this state at the special election called by this 41 act. 42 Section 4. This act shall take effect upon becoming a law 43 if enacted by a vote of at least three-fourths of the membership 44 of each house of the Legislature and if Senate Joint Resolution 45 658 or House Joint Resolution 381 is adopted by both houses of 46 the Legislature.
