    1                           Senate Memorial                         
    2         A memorial to the Congress of the United States,
    3         urging Congress to support repeal of Section 511 of
    4         the Tax Increase Prevention and Reconciliation Act,
    5         which requires governments that annually spend more
    6         than $100 million to withhold a 3 percent federal tax
    7         on payments made for certain goods and services.
    8  
    9         WHEREAS, state purchasing officials serve the public
   10  interest and are charged with maximizing the value of every tax
   11  dollar expended, and
   12         WHEREAS, the unfunded mandate in Section 511 of Pub. L. No.
   13  109-222, 25 U.S.C. 342(t) will result in additional expenditures
   14  of human and budgetary capital to achieve agency compliance and
   15  will dilute the value of taxpayer funds, and
   16         WHEREAS, increases in operating costs will result in
   17  significant reductions of support for critical services to the
   18  public in this state, and
   19         WHEREAS, requiring a 3 percent withholding places an
   20  enormous burden on state and local governments and is extremely
   21  detrimental to the small businesses that are the backbone of
   22  this state’s economy, NOW, THEREFORE,

   24  Be It Resolved by the Legislature of the State of Florida:
   25  
   26         That the Congress of the United States is urged to repeal
   27  the unfunded mandate in Section 511 of Pub. L. No. 109-222, 25
   28  U.S.C. 342(t) and support the repeal of this requirement in S.R.
   29  89 and S.R. 164.
   30         BE IT FURTHER RESOLVED that copies of this memorial be
   31  dispatched to the President of the United States, to the
   32  President of the United States Senate, to the Speaker of the
   33  United States House of Representatives, and to each member of
   34  the Florida delegation to the United States Congress.
