       The Committee on Community Affairs (Dockery) recommended the
       following:
       
    1         Senate Amendment to Amendment (369170) 
    2  
    3         Delete lines 282 - 291
    4  and insert:
    5         (1) Effective July 1, 2011, any county or municipality that
    6  has not adopted an onsite sewage treatment and disposal system
    7  evaluation and assessment program, or that does not opt out of
    8  this section, shall develop and adopt by ordinance a local
    9  onsite sewage treatment and disposal system evaluation and
   10  assessment program within all or part of its geographic area
   11  which meets the requirements of this subsection. Any county or
   12  municipality that has adopted such a program before January 1,
   13  2012, may continue to enforce its provisions. Any county or
   14  municipality that does not opt out of this section shall notify
   15  the Secretary of State by letter of the adoption of the
   16  ordinance pursuant to this section. By a majority of the local
