The Committee on Budget (Negron) recommended the following:
1 Senate Substitute for Amendment (751012) (with title
2 amendment)

4 Delete lines 1501 - 1521
5 and insert:
6 Such immunity does not apply to:
7 a. Any of the foregoing persons or entities for any willful
8 tort;
9 b. The corporation or its producing agents for breach of
10 any contract or agreement pertaining to insurance coverage;
11 c. The corporation with respect to issuance or payment of
12 debt;
13 d. An Any assessable insurer with respect to any action to
14 enforce an assessable insurer’s obligations to the corporation
15 under this subsection; or
16 e. The corporation in any pending or future action for
17 breach of contract or for benefits under a policy issued by the
18 corporation.; In any such action, the corporation is shall be
19 liable to the policyholders and beneficiaries for attorney’s
20 fees under s. 627.428.
