Florida Senate - 2011 SB 1874 By Senator Smith 29-01298-11 20111874__ 1 A bill to be entitled 2 An act relating to child care; amending s. 402.305, 3 F.S.; revising the minimum standards for licensure of 4 child care facilities; requiring the Department of 5 Children and Family Services to establish and contract 6 for an electronic child care attendance verification 7 system; providing for statewide implementation of the 8 system; requiring licensed child care facilities to 9 use the system; providing an effective date. 10 11 Be It Enacted by the Legislature of the State of Florida: 12 13 Section 1. Paragraph (e) is added to subsection (9) of 14 section 402.305, Florida Statutes, to read: 15 402.305 Licensing standards; child care facilities.— 16 (9) ADMISSIONS AND RECORDKEEPING.— 17 (e) The department shall adopt minimum standards for the 18 statewide implementation of an electronic child care attendance 19 verification system that records each child’s daily arrival and 20 departure from the child care facility using a point-of-sale 21 terminal and an identification card issued to the child’s parent 22 or guardian with identifying information encoded on the card’s 23 magnetic strip or stripe. If a parent or guardian fails to 24 present his or her identification card, the electronic system 25 must allow for the child’s attendance to be recorded or allow 26 the parent or guardian to amend the child’s attendance record 27 within 10 days after his or her failure to present the 28 identification card. The department shall contract for the 29 statewide implementation of the electronic child care attendance 30 verification system. Effective January 1, 2012, or upon the 31 statewide implementation, whichever occurs later, a licensed 32 child care facility’s use of the electronic system shall be a 33 required minimum standard for licensing. 34 Section 2. This act shall take effect July 1, 2011.
