       Senator Fasano moved the following:

    4  and insert:
    5         (18) TRANSPORTATION.—Unless otherwise provided for in the
    6  General Appropriations Act, a provider of transportation
    7  services shall be reimbursed the lesser of the amount billed by
    8  the provider or the Medicaid maximum allowable fee established
    9  by the agency, except if when the agency has entered into a
   10  direct contract with the provider, or with a community
   11  transportation coordinator, for the provision of an all
   12  inclusive service, or if when services are provided pursuant to
   13  an agreement negotiated between the agency and the provider. The
   14  agency, as provided for in s. 427.0135, shall purchase
   15  transportation services through the community coordinated
   16  transportation system, if available, unless the agency, after
   17  consultation with the commission, determines that it cannot
   18  reach mutually acceptable contract terms with the commission.
   19  The agency may then contract for the same transportation
   20  services provided in a more cost-effective manner and of
   21  comparable or higher quality and standards. Nothing in
   22         (a) This subsection does not shall be construed to limit or
   23  preclude the agency from contracting for services using a
   24  prepaid capitation rate or from establishing maximum fee
   25  schedules, individualized reimbursement policies by provider
   26  type, negotiated fees, prior authorization, competitive bidding,
   27  increased use of mass transit, or any other mechanism that the
   28  agency considers efficient and effective for the purchase of
   29  services on behalf of Medicaid clients, including implementing a
   30  transportation eligibility process.
   31         (b) The agency may shall not be required to contract with
   32  any community transportation coordinator or transportation
   33  operator that has been determined by the agency, the Department
   34  of Legal Affairs Medicaid Fraud Control Unit, or any other state
   35  or federal agency to have engaged in any abusive or fraudulent
   36  billing activities.
   37         (c) The agency shall is authorized to competitively procure
   38  transportation services or make other changes necessary to
   39  secure approval of federal waivers needed to permit federal
   40  financing of Medicaid transportation services at the service
   41  matching rate rather than the administrative matching rate.
   42  Notwithstanding chapter 427, the agency is authorized to
   43  continue contracting for Medicaid nonemergency transportation
   44  services in agency service area 11 with managed care plans that
   45  were under contract for those services before July 1, 2004.
