House . . . . . ————————————————————————————————————————————————————————————————— ————————————————————————————————————————————————————————————————— Senator Negron moved the following: 1 Senate Amendment (with title amendment) 2 3 Delete lines 6024 - 6051 4 and insert: 5 (15) “Provider service network” means a network authorized 6 under s. 409.912(4)(d), reimbursed on a prepaid basis, operated 7 by a health care provider or group of affiliated health care 8 providers, and which directly provides health care services 9 under a Medicare, Medicaid, or Healthy Kids contract. 10 Section 82. Section 641.2019, Florida Statutes, is created 11 to read: 12 641.2019 Provider service network certificate of 13 authority.—A prepaid provider service network that applies for 14 and obtains a health care provider certificate pursuant to part 15 III of this chapter, meets the surplus requirements of s. 16 641.225, and meets all other applicable requirements of this 17 part may obtain a certificate of authority under s. 641.21. A 18 certified provider service network has the same rights and 19 responsibilities as a health maintenance organization certified 20 under this part. 21 Section 83. Subsection (2) of section 641.2261, Florida 22 Statutes, is amended to read: 23 641.2261 Application of solvency requirements to provider 24 sponsored organizations and Medicaid provider service networks.— 25 (2) Except for a provider service network seeking to obtain 26 a certificate of authority under s. 641.2019, the solvency 27 requirements in 42 C.F.R. s. 422.350, subpart H, and the 28 solvency requirements established in approved federal waivers 29 pursuant to chapter 409 apply to a Medicaid provider service 30 network rather than the solvency requirements of this part. 31 32 ================= T I T L E A M E N D M E N T ================ 33 And the title is amended as follows: 34 Delete line 414 35 and insert: 36 that chapter; amending s. 641.2261, F.S.; limiting the 37 solvency requirements applicable to provider service 38 networks; amending s. 641.47, F.S.; redefining the
