Senator Storms moved the following:

4 insert:
5 Section 6. Subsection (1) of section 464.203, Florida
6 Statutes, is amended to read:
7 464.203 Certified nursing assistants; certification
8 requirement.—
9 (1) The board shall issue a certificate to practice as a
10 certified nursing assistant to any person who demonstrates a
11 minimum competency to read and write and successfully passes the
12 required background screening pursuant to s. 400.215. If the
13 person has successfully passed the required background screening
14 pursuant to s. 400.215 or s. 408.809 within 90 days before
15 applying for a certificate to practice, the board shall waive
16 the requirement that the applicant successfully pass an
17 additional background screening pursuant to s. 400.215. The
18 person must also meet and meets one of the following
19 requirements:
20 (a) Has successfully completed an approved training program
21 and achieved a minimum score, established by rule of the board,
22 on the nursing assistant competency examination, which consists
23 of a written portion and skills-demonstration portion approved
24 by the board and administered at a site and by personnel
25 approved by the department.
26 (b) Has achieved a minimum score, established by rule of
27 the board, on the nursing assistant competency examination,
28 which consists of a written portion and skills-demonstration
29 portion, approved by the board and administered at a site and by
30 personnel approved by the department and:
31 1. Has a high school diploma, or its equivalent; or
32 2. Is at least 18 years of age.
33 (c) Is currently certified in another state; is listed on
34 that state’s certified nursing assistant registry; and has not
35 been found to have committed abuse, neglect, or exploitation in
36 that state.
37 (d) Has completed the curriculum developed under the
38 Enterprise Florida Jobs and Education Partnership Grant and
39 achieved a minimum score, established by rule of the board, on
40 the nursing assistant competency examination, which consists of
41 a written portion and skills-demonstration portion, approved by
42 the board and administered at a site and by personnel approved
43 by the department.
