9 | Be It Enacted by the Legislature of the State of Florida: |

11 | Section 1. Section 843.02, Florida Statutes, is amended to |
12 | read: |
13 | 843.02 Resisting officer or other such person without |
14 | violence to his or her person.-Whoever shall resist, obstruct, |
15 | or oppose any officer as defined in s. 943.10(1), (2), (3), (6), |
16 | (7), (8), or (9); member of the Parole Commission or any |
17 | administrative aide or supervisor employed by the commission; |
18 | county probation officer; parole and probation supervisor; |
19 | personnel or representative of the Department of Law |
20 | Enforcement; or other person legally authorized to execute |
21 | process in the execution of legal process or in the lawful |
22 | execution of any legal duty, without offering or doing violence |
23 | to the person of the officer or other such person, commits shall |
24 | be guilty of a misdemeanor of the first degree, punishable as |
25 | provided in s. 775.082 or s. 775.083. For purposes of this |
26 | section, resistance, obstruction, or opposition must be based on |
27 | factors other than mere flight from an officer or other person |
28 | to whom this section applies. |
29 | Section 2. This act shall take effect July 1, 2011. |
