House Comm: RCS . 04/05/2011 . . . . ————————————————————————————————————————————————————————————————— ————————————————————————————————————————————————————————————————— The Committee on Commerce and Tourism (Lynn) recommended the following: 1 Senate Amendment to Amendment (609550) (with title 2 amendment) 3 4 Delete lines 1507 - 1517 5 and insert: 6 1. Eighty-seven and 1/2 percent shall be deposited into the 7 General Revenue Fund. 8 2. Two and 1/2 percent shall be deposited into the Tourism 9 Promotional Trust Fund for use by the Florida Commission on 10 Tourism. 11 3. One and 1/4 percent shall be deposited into the 12 Employment Security Administration Trust Fund for the benefit of 13 the school readiness program. 14 4. One and 1/4 percent shall be deposited into the 15 Transportation Disadvantaged Trust Fund for use by the 16 Commission for the Transportation Disadvantaged. 17 5. Two and 1/2 percent of the gross receipts tax collected 18 shall be paid to the thoroughbred permitholders who are licensed 19 to conduct slot machines pursuant to s. 551.104, in amounts 20 equal to each permitholder's racing dates operated in 2011 21 divided by the total number of racing dates operated by all 22 thoroughbred permitholders. These funds shall be utilized to 23 offset the statutory mandated purses under s. 551.104(10). Two 24 and 1/2 percent of the gross receipts tax collected shall be 25 paid to the Florida Thoroughbred Breeders and Owners 26 Association, Inc., for the payment of breeders, stallion and 27 special racing awards, including the administrative fee 28 authorized in s. 550.2625(3), on live thoroughbred races 29 conducted at licensed thoroughbred pari-mutuel facilities. These 30 funds, to be governed by the Florida Thoroughbred Breeders and 31 Owners Association, Inc., Board of Directors, may provide for, 32 but not be limited to, use for capital expenditures that will 33 drive economic growth and continue to provide jobs for the 34 Ocala/Marion County area and for Florida's thoroughbred 35 industry, including the rehabilitation or retirement of 36 thoroughbred racehorses, equine research, education, and civic 37 and industryrelated service organizations and charities, while 38 continuing the preservation of over 100,000 acres in production 39 for thoroughbred breeding, training and other equine activities. 40 The amounts provided therein shall be remitted monthly. 41 6. Two and 1/2 percent of the gross receipts tax collected 42 shall be provided to the permitholders conducting live greyhound 43 or harness racing or jai alai games to offset purse requirements 44 pursuant to a contractual arrangement between each permitholder 45 and the greyhound owners, the standardbred owners, and the jai 46 alai players and shall be paid to such permitholders who are 47 licensed to conduct slot machines pursuant to s. 551.104, in 48 amounts equal to each such permitholder's total purses paid on 49 live racing or games divided by the total amount of purses paid 50 by all such permitholders. 51 52 ================= T I T L E A M E N D M E N T ================ 53 And the title is amended as follows: 54 Delete lines 2266 - 2267 55 and insert: 56 Employment Security Administration Trust Fund, the 57 Transportation Disadvantaged Trust Fund, thoroughbred 58 permitholders, the Florida Thoroughbred Breeders and 59 Owners Association, and the permitholders licensed to 60 conduct live greyhound races, harness races, or jai 61 alai licensees; providing for
