Senator Diaz de la Portilla moved the following:
1 Senate Amendment (with title amendment)

3 Delete everything after the enacting clause
4 and insert:
5 Section 1. Paragraph (d) of subsection (8) of section
6 112.3215, Florida Statutes, is amended to read:
7 112.3215 Lobbying before the executive branch or the
8 Constitution Revision Commission; registration and reporting;
9 investigation by commission.—

11 (d)1. Records relating to an audit conducted pursuant to
12 this section or an investigation conducted pursuant to this
13 section or s. 112.32155 are confidential and exempt from s.
14 119.07(1) and s. 24(a), Art. I of the State Constitution., and
15 2. Any portion of a meeting wherein meetings held pursuant
16 to such an investigation or at which such an audit is discussed
17 is are exempt from s. 286.011 and s. 24(b), Art. I of the State
18 Constitution.
19 3. The exemptions no longer apply if either until the
20 lobbying firm requests in writing that such investigation and
21 associated records and meetings be made public or until the
22 commission determines there is probable cause that the audit
23 reflects a violation of the reporting laws. This paragraph is
24 subject to the Open Government Sunset Review Act in accordance
25 with s. 119.15 and shall stand repealed on October 2, 2011,
26 unless reviewed and saved from repeal through reenactment by the
27 Legislature.
28 Section 2. This act shall take effect October 1, 2011.

34 A bill to be entitled
35 An act relating to a review under the Open Government
36 Sunset Review Act; amending s. 112.3215, F.S., which
37 provides an exemption from public records and public
38 meetings requirements for certain audits and
39 investigations conducted by the Commission on Ethics;
40 reorganizing the exemptions; making editorial changes;
41 removing the scheduled repeal of the exemptions;
42 providing an effective date.
