       Senator Siplin moved the following:
       
    1         Senate Amendment 
    2  
    3         Delete lines 1263 - 1275
    4  and insert:
    5         (4) An authority or fair association as defined in this
    6  chapter that provides any of the exhibits set forth in
    7  subsection (1) or other exhibits or concessions, whether such
    8  exhibits or concessions are provided directly or through an
    9  agreement with a third party, is not subject to criminal
   10  penalties or civil damages arising out of the personal injury or
   11  death of any person, or property damage, resulting from such
   12  exhibits or concessions. This subsection does not apply if the
   13  personal injury, death, or property damage was due to an act or
   14  omission committed by the authority or fair association in bad
   15  faith, with malicious purpose, or with wanton and willful
   16  disregard of human rights, safety, or property. This subsection
   17  does not apply to third parties providing exhibits or
   18  concessions.
