       Senators Ring, Margolis, Rich, Braynon, Sobel, Smith, Siplin,
       Joyner, Montford, and Hill moved the following:
       
    1         Senate Amendment 
    2  
    3         Delete lines 459 - 509
    4  and insert:
    5         4. Up to 300 hours of overtime payments paid from a salary
    6  fund.
    7         (c)(b)Under no circumstances shall Compensation for a
    8  member participating in the pension plan defined benefit
    9  retirement program or the investment plan Public Employee
   10  Optional Retirement Program of the Florida Retirement System may
   11  not include:
   12         1. Fees paid professional persons for special or particular
   13  services or include salary payments made from a faculty practice
   14  plan authorized by the Board of Governors of the State
   15  University System for eligible clinical faculty at a college in
   16  a state university that has a faculty practice plan; or
   17         2. Any bonuses or other payments prohibited from inclusion
   18  in the member’s average final compensation and defined in
   19  subsection (47).
   20         (24) “Average final compensation” means the average of the
   21  5 highest fiscal years of compensation for creditable service
   22  prior to retirement, termination, or death. For in-line-of-duty
   23  disability benefits, if less than 5 years of creditable service
   24  have been completed, the term “average final compensation” means
   25  the average annual compensation of the total number of years of
   26  creditable service. Each year used to calculate the in the
   27  calculation of average final compensation commences shall
   28  commence on July 1.
   29         (a) Before July 1, 2011:
   30         1. The average final compensation includes shall include:
   31         a.1. Accumulated annual leave payments, not to exceed 500
   32  hours; and
   33         b.2. All payments defined as compensation under this
   34  section in subsection (22).
   35         2.(b) The average final compensation does shall not
   36  include:
   37         a.1. Compensation paid to professional persons for special
   38  or particular services;
   39         b.2. Payments for accumulated sick leave made due to
   40  retirement or termination;
   41         c.3. Payments for accumulated annual leave in excess of 500
   42  hours;
   43         d.4. Bonuses as defined in subsection (47);
   44         e.5.Third-party Third party payments made on and after
   45  July 1, 1990; or
   46         f.6. Fringe benefits, such as (for example, automobile
   47  allowances or housing allowances).
   48         (b) On or after July 1, 2011:
   49         1. The average final compensation includes all payments
   50  defined as compensation under this section.
   51         2. The average final compensation does not include:
   52         a. Compensation paid to professional persons for special or
   53  particular services;
   54         b. Payments for accumulated sick leave made due to
   55  retirement or termination;
   56         c. Payments for accumulated annual leave;
   57         d. Payments for overtime exceeding 300 hours paid from a
   58  salary fund;
