    1                        A bill to be entitled                      
    2         An act relating to district school board members;
    3         amending ss. 145.19 and 1001.39, F.S.; conforming
    4         cross-references; amending s. 1001.395, F.S.; removing
    5         provisions relating to base salary and additional
    6         compensation for a district school board member;
    7         prohibiting district school board members from
    8         receiving more than a $100 stipend per school board
    9         meeting; capping the annual stipend; providing that
   10         the stipend does not constitute compensation for
   11         retirement purposes; providing reimbursement for
   12         travel expenses; prohibiting district school board
   13         members from receiving any compensation while serving;
   14         providing for application; providing an effective
   15         date.

   17  Be It Enacted by the Legislature of the State of Florida:
   18  
   19         Section 1. Subsection (2) of section 145.19, Florida
   20  Statutes, is amended to read:
   21         145.19 Annual percentage increases based on increase for
   22  state career service employees; limitation.—
   23         (2) Each fiscal year, the salaries of all officials listed
   24  in this chapter, s. 1001.395, and s. 1001.47 shall be adjusted.
   25  The adjusted salary rate shall be the product, rounded to the
   26  nearest dollar, of the salary rate granted by the appropriate
   27  section of this chapter, s. 1001.395, or s. 1001.47 multiplied
   28  first by the initial factor, then by the cumulative annual
   29  factor, and finally by the annual factor. The Department of
   30  Management Services shall certify the annual factor and the
   31  cumulative annual factors. Any special qualification salary
   32  received under this chapter, s. 1001.47, or the annual
   33  performance salary incentive available to elected
   34  superintendents under s. 1001.47 shall be added to such adjusted
   35  salary rate. The special qualification salary shall be $2,000,
   36  but shall not exceed $2,000.
   37         Section 2. Section 1001.39, Florida Statutes, is amended to
   38  read:
   39         1001.39 District school board members; travel expenses.—
   40         (1) In addition to the salary provided in s. 1001.395, Each
   41  member of a district school board shall be allowed, from the
   42  district school fund, reimbursement of travel expenses as
   43  authorized in s. 112.061, except as provided in subsection (2).
   44  Any travel outside the district shall also be governed by the
   45  rules of the State Board of Education.
   46         (2) Each district school board may reimburse a district
   47  school board member for travel expenses for travel from the
   48  member’s residence incurred in the performance of a public
   49  purpose authorized by law to be performed by the district school
   50  board, including, but not limited to, attendance at regular and
   51  special board meetings. Mileage allowance in the amount provided
   52  by law for reimbursement of travel expenses, when authorized,
   53  shall be computed from the member’s place of residence to the
   54  place of the meeting or function and return.
   55         Section 3. Section 1001.395, Florida Statutes, is amended
   56  to read:
   57         1001.395 District school board members; stipend;
   58  reimbursement for travel expenses compensation.—
   59         (1)District school board members may not receive more than
   60  a $100 stipend per school board meeting, which does not
   61  constitute compensation for purposes of retirement. The maximum
   62  stipend per school board member may not exceed $2,400 per year.
   63  District school board members may receive reimbursement for
   64  travel expenses in accordance with s. 1001.39. District school
   65  board members shall otherwise serve without compensation. Each
   66  member of the district school board shall receive a base salary,
   67  the amounts indicated in this section, based on the population
   68  of the county the district school board member serves. In
   69  addition, compensation shall be made for population increments
   70  over the minimum for each population group, which shall be
   71  determined by multiplying the population in excess of the
   72  minimum for the group times the group rate. The product of such
   73  calculation shall be added to the base salary to determine the
   74  adjusted base salary. The adjusted base salaries of district
   75  school board members shall be increased annually as provided for
   76  in s. 145.19.

   86         (2) Notwithstanding the provisions of this section or s.
   87  145.19, district school board members may reduce their salary
   88  rate on a voluntary basis.
   89         (3) Notwithstanding the provisions of this section and s.
   90  145.19, for the 2010-2011 fiscal year, the salary of each
   91  district school board member shall be the amount calculated
   92  pursuant to subsection (1) or the district’s beginning salary
   93  for teachers who hold baccalaureate degrees, whichever is less.
   94         Section 4. The amendments made by this act to ss. 145.19,
   95  1001.39, and 1001.395, Florida Statutes, apply to district
   96  school board members elected or reelected in the general
   97  election of 2012 and thereafter.
   98         Section 5. This act shall take effect July 1, 2011.
