The Committee on Health Regulation (Bennett) recommended the
following:

4 and insert:
5 Section 6. Subsection (22) is added to section 318.18,
6 Florida Statutes, to read:
7 318.18 Amount of penalties.—The penalties required for a
8 noncriminal disposition pursuant to s. 318.14 or a criminal
9 offense listed in s. 318.17 are as follows:
10 (22) In addition to any penalties or points imposed under
11 subsection s. 316.1923, a person convicted of aggressive
12 careless driving shall also pay:
13 (a) Upon a first violation, a fine of $100.
14 (b) Upon a second or subsequent conviction, a fine of not
15 less than $250 but not more than $500 and be subject to a
16 mandatory hearing under s. 318.19.

18 The clerk of the court shall remit the moneys collected from the
19 increased fine imposed by this subsection to the Department of
20 Revenue for deposit into the Department of Health Administrative
21 Trust Fund. Of the funds deposited into the Department of Health
22 Administrative Trust Fund, $200,000 in the first year after this
23 act takes effect, and $50,000 in the second and third years,
24 shall be transferred into the Highway Safety Operating Trust
25 Fund to offset the cost of providing educational materials
26 related to this act. Funds deposited into the Department of
27 Health Administrative Trust Fund under this subsection shall be
28 allocated as follows:
29 1. Twenty-five percent shall be allocated equally among all
30 Level I, Level II, and pediatric trauma centers in recognition
31 of readiness costs for maintaining trauma services.
32 2. Twenty-five percent shall be allocated among Level I,
33 Level II, and pediatric trauma centers based on each center’s
34 relative volume of trauma cases as reported in the Department of
35 Health Trauma Registry.
36 3. Twenty-five percent shall be transferred to the
37 Emergency Medical Services Trust Fund and used by the department
38 for making matching grants to emergency medical services
39 organizations as defined in s. 401.107.
40 4. Twenty-five percent shall be transferred to the
41 Emergency Medical Services Trust Fund and made available to
42 rural emergency medical services as defined in s. 401.107, and
43 shall be used solely to improve and expand prehospital emergency
44 medical services in this state. Additionally, these moneys may
45 be used for the improvement, expansion, or continuation of
46 services provided.
