A bill to be entitled
2An act relating to the Century Commission for a
3Sustainable Florida; amending s. 163.3247, F.S.; revising
4provisions relating to the Century Commission for a
5Sustainable Florida; revising the findings and intent to
6include the necessity for a specific strategic plan
7addressing the state's growth management system; revising
8the planning timeframes to include a 10-year horizon;
9revising membership of the commission; deleting obsolete
10provisions regarding initial appointments; providing for
11the election of a chair and excluding certain members from
12serving as chair during a specified period; requiring that
13the commission meet at least six times per fiscal year;
14deleting a provision that requires the commission to meet
15in different regions in the state; requiring that the
16executive director establish a meeting calendar with the
17commission's approval; authorizing the commission to form
18subcommittees by vote; providing for a majority vote of
19members on commission actions; providing for reimbursement
20for per diem and travel expenses; revising provisions
21relating to the commission's powers and duties; requiring
22that the commission, in cooperation with interested state
23agencies, local governments, and nongovernmental
24stakeholders, develop a strategic plan and submit the plan
25to the Governor and the Legislature by a specified date;
26requiring that the commission also submit progress reports
27by specified dates; requiring that the commission make
28presentations to the Governor and the Legislature;
29providing that an executive director be appointed by the
30Secretary of Community Affairs and ratified by the
31commission; requiring that the Department of Community
32Affairs provide a specific line item in its annual
33legislative budget request to fund the commission during a
34specified period; authorizing the department to obtain
35additional funding through external grants; requiring that
36the department provide sufficient funding and staff
37support to assist the commission in its duties; providing
38for future expiration and the abolishment of the
39commission; providing an effective date.

41Be It Enacted by the Legislature of the State of Florida:
42
43     Section 1.  Section 163.3247, Florida Statutes, as amended
44by section 42 of chapter 2010-153, Laws of Florida, is amended,
45and subsection (6) is added to that section, to read:
46     163.3247  Century Commission for a Sustainable Florida.-
47     (1)  POPULAR NAME.-This section may be cited as the
48"Century Commission for a Sustainable Florida Act."
49     (2)  FINDINGS AND INTENT.-The Legislature finds and
50declares that the population of this state is expected to more
51than double over the next 100 years, with commensurate impacts
52to the state's natural resources and public infrastructure.
53Consequently, it is in the best interests of the people of the
54state to ensure sound planning for the proper placement of this
55growth and protection of the state's land, water, and other
56natural resources since such resources are essential to our
57collective quality of life and a strong economy. The state's
58growth management system should foster economic stability
59through regional solutions and strategies, urban renewal and
60infill, and the continued viability of agricultural economies,
61while allowing for rural economic development and protecting the
62unique characteristics of rural areas, and should reduce the
63complexity of the regulatory process while carrying out the
64intent of the laws and encouraging greater citizen
65participation. The Legislature further finds that it is
66imperative that the state have a specific strategic plan
67addressing its growth management system.
68     (3)  CENTURY COMMISSION FOR A SUSTAINABLE FLORIDA;
69CREATION; ORGANIZATION.-The Century Commission for a Sustainable
70Florida is created as a standing body to help the citizens of
71this state envision and plan their collective future with an eye
72towards 10-year, both 25-year, and 50-year horizons.
73     (a)  The commission shall consist of 18 15 members
74appointed as follows:,
75     1.  Two members 5 appointed by the Governor;,
76     2.  Five members 5 appointed by the President of the
77Senate;, and
78     3.  Five members 5 appointed by the Speaker of the House of
79Representatives;
80     4.  The chairs of the legislative growth management
81committees;
82     5.  The Secretary of Community Affairs;
83     6.  The Secretary of Environmental Protection;
84     7.  The Secretary of Transportation; and
85     8.  The director of the Office of Tourism, Trade, and
86Economic Development.
87     (b)  Appointments shall be made no later than October 1,
882005. Members of the commission The membership must represent
89local governments, school boards, developers and homebuilders,
90the business community, the agriculture community, the
91environmental community, and other appropriate stakeholders.
92Beginning July 1, 2011, through June 30, 2013, one member shall
93be elected to serve as chair by a vote of the commission
94membership. However, the chairs of the legislative growth
95management committees, the Secretary of Community Affairs, the
96Secretary of Environmental Protection, the Secretary of
97Transportation, and the director of the Office of Tourism,
98Trade, and Economic Development may not serve as chair during
99this period designated by the Governor as chair of the
100commission. Any vacancy that occurs on the commission must be
101filled in the same manner as the original appointment and shall
102be for the unexpired term of that commission seat. Members shall
103serve 4-year terms, except that, initially, to provide for
104staggered terms, the Governor, the President of the Senate, and
105the Speaker of the House of Representatives shall each appoint
106one member to serve a 2-year term, two members to serve 3-year
107terms, and two members to serve 4-year terms. Members shall be
108appointed to serve All subsequent appointments shall be for 4-
109year terms. An appointee may not serve more than 6 years.
110However, members who are appointed on or before January 1, 2011,
111shall have their terms automatically extended to June 30, 2013,
112to ensure continuity during the development of the strategic
113plan.
114     (c)(b)  The fiscal year of the commission begins July 1
115each year and ends June 30 of the following year. The first
116meeting of The commission shall be held no later than December
1171, 2005, and shall meet at the call of the chair but not less
118frequently than six three times per fiscal year in different
119regions of the state to solicit input from the public or any
120other individuals offering testimony relevant to the issues to
121be considered. The executive director shall establish a meeting
122calendar for the fiscal year which considers the availability of
123members. The commission must vote to approve the meeting
124calendar before the beginning of the fiscal year. The commission
125may vote to form subcommittees and schedule meetings as
126necessary.
127     (d)(c)  Each member of the commission is entitled to one
128vote, and the actions of the commission are not binding unless
129taken by a majority three-fifths vote of the members present. A
130majority of the members is required to constitute a quorum, and
131the affirmative vote of a quorum is required for a binding vote.
132     (e)(d)  Members of the commission shall serve without
133compensation, but are shall be entitled to receive reimbursement
134for per diem and travel expenses as provided in accordance with
135s. 112.061 while in the performance of their duties.
136     (4)  POWERS AND DUTIES.-
137     (a)  The commission shall:
138     (a)  Annually conduct a process through which the
139commission envisions the future for the state and then develops
140and recommends policies, plans, action steps, or strategies to
141assist in achieving the vision.
142     (b)  Continuously review and consider statutory and
143regulatory provisions, governmental processes, and societal and
144economic trends in its inquiry of how state, regional, and local
145governments and entities and citizens of this state can best
146accommodate projected increased populations while maintaining
147the natural, historical, cultural, and manmade life qualities
148that best represent the state.
149     (c)  bring together people representing varied interests to
150develop a shared image of the state and its developed and
151natural areas. The process should involve exploring the impact
152of the estimated population increase and other emerging trends
153and issues; creating a vision for the future; and developing a
154strategic action plan to achieve that vision using 10-year, 25-
155year, and 50-year intermediate planning timeframes. The plan
156must:
157     1.(d)  Focus on essential state interests, defined as those
158interests that transcend local or regional boundaries and are
159most appropriately conserved, protected, and promoted at the
160state level;.
161     2.  Accommodate the projections for an increase in
162population while maintaining the state's natural, historical,
163cultural, and manmade life qualities; and
164     3.  Be developed through a coordinated, integrated, and
165comprehensive effort across agencies, local governments, and
166nongovernmental stakeholders.
167     (b)  The commission shall submit the strategic plan to the
168Governor and the Legislature by November 15, 2012, along with
169progress reports by November 15, 2011, and March 15, 2012. The
170commission shall also make presentations, at least annually, to
171the Governor and the Legislature.
172     (e)  Serve as an objective, nonpartisan repository of
173exemplary community-building ideas and as a source to recommend
174strategies and practices to assist others in working
175collaboratively to problem solve on issues relating to growth
176management.
177     (f)  Annually, beginning January 16, 2007, and every year
178thereafter on the same date, provide to the Governor, the
179President of the Senate, and the Speaker of the House of
180Representatives a written report containing specific
181recommendations for addressing growth management in the state,
182including executive and legislative recommendations. Further,
183the report shall contain discussions regarding the need for
184intergovernmental cooperation and the balancing of environmental
185protection and future development and recommendations on issues,
186including, but not limited to, recommendations regarding
187dedicated sources of funding for sewer facilities, water supply
188and quality, transportation facilities that are not adequately
189addressed by the Strategic Intermodal System, and educational
190infrastructure to support existing development and projected
191population growth.
192     (c)(g)  Beginning with the 2007 Regular Session of the
193Legislature, the President of the Senate and the Speaker of the
194House of Representatives shall create a joint select committee,
195the task of which shall be to review the findings and
196recommendations of the Century Commission for a Sustainable
197Florida for potential action.
198     (5)  EXECUTIVE DIRECTOR; STAFF AND OTHER ASSISTANCE.-
199     (a)  The Secretary of Community Affairs shall select An
200executive director shall be appointed by the Secretary of
201Community Affairs and ratified by the commission and of the
202commission, and the executive director shall serve at the
203pleasure of the secretary under the supervision and control of
204the commission under the direction of the chair.
205     (b)  The Department of Community Affairs shall provide a
206specific line item in its annual legislative budget request to
207fund the commission for the period beginning July 1, 2011,
208through June 30, 2013. The department may obtain additional
209funding through external grants. The department shall provide
210sufficient funds and staff support for the purpose of assisting
211the commission in completing the strategic plan staff and other
212resources necessary to accomplish the goals of the commission
213based upon recommendations of the Governor.
214     (c)  All agencies under the control of the Governor are
215directed, and all other agencies are requested, to render
216assistance to, and cooperate with, the commission.
217     (6)  EXPIRATION.-This section expires and the commission is
218abolished June 30, 2013.
219     Section 2.  This act shall take effect July 1, 2011.
