    1                        A bill to be entitled                      
    2         An act relating to trust funds; creating the
    3         Sustainable and Renewable Energy Policy Trust Fund
    4         within the Florida Energy and Climate Commission;
    5         providing for sources of funds and purposes; providing
    6         for annual carryforward of funds; providing for the
    7         future review and termination or re-creation of the
    8         trust fund; providing a contingent effective date.

   10  Be It Enacted by the Legislature of the State of Florida:
   11  
   12         Section 1. (1) The Sustainable and Renewable Energy Policy
   13  Trust Fund is created within the Florida Energy and Climate
   14  Commission. The trust fund shall be administered by the
   15  commission. Funds allocated to the trust fund include funds
   16  received from state appropriations, federal and state grants,
   17  and deposits consisting of the monthly service charge collected
   18  by the electric utilities in the state from every residential,
   19  commercial, and industrial consumer of electric service. The
   20  funds in the trust fund shall be used to support the activities
   21  of the direct-support organization of the commission relating to
   22  sustainable and renewable energy projects in this state.
   23         (2) Notwithstanding s. 216.301, Florida Statutes, and
   24  pursuant to s. 216.351, Florida Statutes, any balance in the
   25  trust fund at the end of any fiscal year shall remain in the
   26  trust fund and shall be available for carrying out the purposes
   27  of the trust fund.
   28         (3) In accordance with s. 19(f)(2), Article III of the
   29  State Constitution, the Sustainable and Renewable Energy Policy
   30  Trust Fund shall, unless terminated sooner, be terminated on
   31  July 1, 2015. Before its scheduled termination, the trust fund
   32  shall be reviewed as provided in s. 215.3206(1) and (2), Florida
   33  Statutes.
   34         Section 2. This act shall take effect on the same date that
   35  Senate Bill ____ or similar legislation takes effect, if such
   36  legislation is adopted in the same legislative session or an
   37  extension thereof and becomes law.
