1 A bill to be entitled
2 An act relating to postsecondary student fees;
3 creating s. 1009.215, F.S.; providing an exemption
4 from payment of nonresident tuition at a state
5 university or a Florida College System institution for
6 an undocumented student who meets specified
7 requirements; requiring the Board of Governors of the
8 State University System to adopt regulations and the
9 State Board of Education to adopt rules; providing an
10 effective date.

12 Be It Enacted by the Legislature of the State of Florida:

14 Section 1. Section 1009.215, Florida Statutes, is created
15 to read:
16 1009.215 Nonresident tuition exemption.—
17 (1) Beginning with the 2011 fall term, an undocumented
18 student, other than a nonimmigrant alien within the meaning of 8
19 U.S.C. s. 1101(a)(15), is exempt from paying nonresident tuition
20 at a state university or a Florida College System institution if
21 the student meets all of the following requirements:
22 (a) Attended high school in the state for 3 or more years,
23 which need not be consecutive.
24 (b) Graduated from a high school in the state or attained a
25 high school equivalency diploma pursuant to s. 1003.435.
26 (c) Registered as an entering student or is currently
27 enrolled at a state university or a Florida College System
28 institution.
29 (d) Files an affidavit with the state university or the
30 Florida College System institution stating that the student has
31 filed an application to legalize his or her immigration status
32 or will file an application as soon as he or she is eligible to
33 do so.
34 (2) The Board of Governors shall adopt regulations and the
35 State Board of Education shall adopt rules to implement the
36 nonresident tuition exemption provided in this section.
37 Section 2. This act shall take effect July 1, 2011.
