4 substances included in Schedules I, II, III, IV, and
5 V; providing an effective date.

7 Be It Enacted by the Legislature of the State of Florida:

9 Section 1. Section 893.03, Florida Statutes, is amended to
10 read:
11 893.03 Standards and schedules.—The substances enumerated
12 in this section are controlled by this chapter. The controlled
13 substances listed or to be listed in Schedules I, II, III, IV,
14 and V are included by whatever official, common, usual,
15 chemical, or trade name designated. The provisions of this
16 section do shall not be construed to include within any of the
17 schedules contained in this section any excluded drugs listed
18 within the purview of 21 C.F.R. s. 1308.22, styled “Excluded
19 Substances”; 21 C.F.R. s. 1308.24, styled “Exempt Chemical
20 Preparations”; 21 C.F.R. s. 1308.32, styled “Exempted
21 Prescription Products”; or 21 C.F.R. s. 1308.34, styled “Exempt
22 Anabolic Steroid Products.”
23 (1) SCHEDULE I.—A substance in Schedule I has a high
24 potential for abuse and does not have any has no currently
25 accepted medical use in treatment in the United States and in
26 its use under medical supervision does not meet accepted safety
27 standards. The following substances are controlled in Schedule
28 I:
29 (a) Unless specifically excepted or unless listed in
30 another schedule, any of the following substances, including
31 their isomers, esters, ethers, salts, and salts of isomers,
32 esters, and ethers, whenever the existence of such isomers,
33 esters, ethers, and salts is possible within the specific
34 chemical designation:
35 1. Acetyl-alpha-methylfentanyl.
36 2. Acetylmethadol.
37 3. Allylprodine.
38 4. Alphacetylmethadol (except levo-alphacetylmethadol, also
39 known as levo-alpha-acetylmethadol, levomethadyl acetate, or
40 LAAM).
41 5. Alphamethadol.
42 6. Alpha-methylfentanyl (N-[1-(alpha-methyl-betaphenyl)

180 36. Salvinorin A, except for any drug product approved by
181 the United States Food and Drug Administration which contains
182 Salvinorin A or its isomers, esters, ethers, salts, and salts of
183 isomers, esters, and ethers, whenever the existence of such
184 isomers, esters, ethers, and salts is possible within the
185 specific chemical designation.
186 37. Tetrahydrocannabinols.
187 38. 1-[1-(2-Thienyl)-cyclohexyl]-piperidine (TCP)
188 (Thiophene analog of phencyclidine).
189 39. 3,4,5-Trimethoxyamphetamine.
190 40. Alpha-Methyltryptamine.
191 41. 1-(1-Phenylcyclohexyl) pyrrolidine.
192 42. 2,5-Dimethoxy-4-(n)-Propylthiophenethylamine.

204 (d) Unless specifically excepted or unless listed in
205 another schedule, any material, compound, mixture, or
206 preparation that which contains any quantity of the following
207 substances, including any of its salts, isomers, optical
208 isomers, salts of their isomers, and salts of these optical
209 isomers whenever the existence of such isomers and salts is
210 possible within the specific chemical designation:
211 1. 1,4-Butanediol.
212 2. Gamma-butyrolactone (GBL).
213 3. Gamma-hydroxybutyric acid (GHB).
214 4. Methaqualone.
215 5. Mecloqualone.
216 (2) SCHEDULE II.—A substance in Schedule II has a high
217 potential for abuse and has a currently accepted but severely
218 restricted medical use in treatment in the United States, and
219 abuse of the substance may lead to severe psychological or
220 physical dependence. The following substances are controlled in
221 Schedule II:
222 (a) Unless specifically excepted or unless listed in
223 another schedule, any of the following substances, whether
224 produced directly or indirectly by extraction from substances of
225 vegetable origin or independently by means of chemical
226 synthesis:
227 1. Opium and any salt, compound, derivative, or preparation
228 of opium, except nalmefene or isoquinoline alkaloids of opium,
229 including, but not limited to the following:
230 a. Raw opium.
231 b. Opium extracts.
232 c. Opium fluid extracts.
233 d. Powdered opium.
234 e. Granulated opium.
235 f. Tincture of opium.
236 g. Codeine.
237 h. Ethylmorphine.
238 i. Etorphine hydrochloride.
239 j. Hydrocodone.
240 k. Hydromorphone.
241 l. Levo-alphacetylmethadol (also known as levo-alpha
242 acetylmethadol, levomethadyl acetate, or LAAM).
243 m. Metopon (methyldihydromorphinone).
244 n. Morphine.
245 o. Oxycodone.
246 p. Oxymorphone.
247 q. Thebaine.
248 r. Dihydroetorphine.
249 2. Any salt, compound, derivative, or preparation of a
250 substance which is chemically equivalent to or identical with
251 any of the substances referred to in subparagraph 1., except
252 that these substances shall not include the isoquinoline
253 alkaloids of opium.
254 3. Any part of the plant of the species Papaver somniferum,
255 L.
256 4. Cocaine or ecgonine, including any of their
257 stereoisomers, and any salt, compound, derivative, or
258 preparation of cocaine or ecgonine.
259 (b) Unless specifically excepted or unless listed in
260 another schedule, any of the following substances, including
261 their isomers, esters, ethers, salts, and salts of isomers,
262 esters, and ethers, whenever the existence of such isomers,
263 esters, ethers, and salts is possible within the specific
264 chemical designation:
265 1. Alfentanil.
266 2. Alphaprodine.
267 3. Anileridine.
268 4. Bezitramide.
269 5. Bulk propoxyphene (nondosage forms).
270 6. Carfentanil.
271 7. Dihydrocodeine.
272 8. Diphenoxylate.
273 9. Fentanyl.

275 11. Levomethorphan.

277 13. Metazocine.

306 1. Amobarbital.
307 2. Amphetamine.
308 3. Glutethimide.
309 4. Methamphetamine.
310 5. Methylphenidate.
311 6. Pentobarbital.
312 7. Phenmetrazine.
313 8. Phenylacetone.
314 9. Secobarbital.
315 (3) SCHEDULE III.—A substance in Schedule III has a
316 potential for abuse less than the substances contained in
317 Schedules I and II and has a currently accepted medical use in
318 treatment in the United States, and abuse of the substance may
319 lead to moderate or low physical dependence or high
320 psychological dependence or, in the case of anabolic steroids,
321 may lead to physical damage. The following substances are
322 controlled in Schedule III:
323 (a) Unless specifically excepted or unless listed in
324 another schedule, any material, compound, mixture, or
325 preparation that which contains any quantity of the following
326 substances having a depressant or stimulant effect on the
327 nervous system, including its salts, isomers, and salts of
328 isomers, whenever the existence of such salts, isomers, and
329 salts of isomers is possible within the specific chemical
330 designation:
331 1. Any substance that which contains any quantity of a
332 derivative of barbituric acid, including thiobarbituric acid, or
333 any salt of a derivative of barbituric acid or thiobarbituric
334 acid, including, but not limited to, butabarbital and
335 butalbital.
336 2. Benzphetamine.
337 3. Chlorhexadol.
338 4. Chlorphentermine.
339 5. Clortermine.
340 6. Lysergic acid.
341 7. Lysergic acid amide.
342 8. Methyprylon.
343 9. Phendimetrazine.
344 10. Sulfondiethylmethane.
345 11. Sulfonethylmethane.
346 12. Sulfonmethane.
347 13. Tiletamine and zolazepam or any salt thereof.
348 14. Embutramide.
349 (b) Nalorphine.
350 (c) Unless specifically excepted or unless listed in
351 another schedule, any material, compound, mixture, or
352 preparation containing limited quantities of any of the
353 following controlled substances or any salts thereof:
354 1. Not more than 1.8 grams of codeine per 100 milliliters
355 or not more than 90 milligrams per dosage unit, with an equal or
356 greater quantity of an isoquinoline alkaloid of opium.
357 2. Not more than 1.8 grams of codeine per 100 milliliters
358 or not more than 90 milligrams per dosage unit, with recognized
359 therapeutic amounts of one or more active ingredients that which
360 are not controlled substances.
361 3. Not more than 300 milligrams of hydrocodone per 100
362 milliliters or not more than 15 milligrams per dosage unit, with
363 a fourfold or greater quantity of an isoquinoline alkaloid of
364 opium.
365 4. Not more than 300 milligrams of hydrocodone per 100
366 milliliters or not more than 15 milligrams per dosage unit, with
367 recognized therapeutic amounts of one or more active ingredients
368 that are not controlled substances.
369 5. Not more than 1.8 grams of dihydrocodeine per 100
370 milliliters or not more than 90 milligrams per dosage unit, with
371 recognized therapeutic amounts of one or more active ingredients
372 that which are not controlled substances.
373 6. Not more than 300 milligrams of ethylmorphine per 100
374 milliliters or not more than 15 milligrams per dosage unit, with
375 one or more active, nonnarcotic ingredients in recognized
376 therapeutic amounts.
377 7. Not more than 50 milligrams of morphine per 100
378 milliliters or per 100 grams, with recognized therapeutic
379 amounts of one or more active ingredients that which are not
380 controlled substances.

382 For purposes of charging a person with a violation of s. 893.135
383 involving any controlled substance described in subparagraph 3.
384 or subparagraph 4., the controlled substance is a Schedule III
385 controlled substance pursuant to this paragraph but the weight
386 of the controlled substance per milliliters or per dosage unit
387 is not relevant to the charging of a violation of s. 893.135.
388 The weight of the controlled substance shall be determined
389 pursuant to s. 893.135(6).
390 (d) Anabolic steroids.
391 1. The term “anabolic steroid” means any drug or hormonal
392 substance, chemically and pharmacologically related to
393 testosterone, other than estrogens, progestins, and
394 corticosteroids, that promotes muscle growth and includes:
395 a. Androsterone.
396 b. Androsterone acetate.
397 c. Boldenone.
398 d. Boldenone acetate.
399 e. Boldenone benzoate.
400 f. Boldenone undecylenate.
401 g. Chlorotestosterone (4-chlortestosterone).
402 h. Clostebol.
403 i. Dehydrochlormethyltestosterone.
404 j. Dihydrotestosterone (4-dihydrotestosterone).
405 k. Drostanolone.
406 l. Ethylestrenol.
407 m. Fluoxymesterone.
408 n. Formebulone (formebolone).
409 o. Mesterolone.
410 p. Methandienone.
411 q. Methandranone.
412 r. Methandriol.
413 s. Methandrostenolone.
414 t. Methenolone.
415 u. Methyltestosterone.
416 v. Mibolerone.
417 w. Nandrolone.
418 x. Norethandrolone.
419 y. Nortestosterone.
420 z. Nortestosterone decanoate.
421 aa. Nortestosterone phenylpropionate.

441 uu. Trenbolone acetate.
442 vv. Any salt, ester, or isomer of a drug or substance
443 described or listed in this subparagraph if that salt, ester, or
444 isomer promotes muscle growth.
445 2. The term does not include an anabolic steroid that is
446 expressly intended for administration through implants to cattle
447 or other nonhuman species and that has been approved by the
448 United States Secretary of Health and Human Services for such
449 administration. However, any person who prescribes, dispenses,
450 or distributes such a steroid for human use is considered to
451 have prescribed, dispensed, or distributed an anabolic steroid
452 within the meaning of this paragraph.
453 (e) Ketamine, including any isomers, esters, ethers, salts,
454 and salts of isomers, esters, and ethers, whenever the existence
455 of such isomers, esters, ethers, and salts is possible within
456 the specific chemical designation.
457 (f) Dronabinol (synthetic THC) in sesame oil and
458 encapsulated in a soft gelatin capsule in a drug product
459 approved by the United States Food and Drug Administration.
460 (g) Any drug product containing gamma-hydroxybutyric acid,
461 including its salts, isomers, and salts of isomers, for which an
462 application is approved under s. 505 of the Federal Food, Drug,
463 and Cosmetic Act.
464 (4) SCHEDULE IV.—A substance in Schedule IV has a low
465 potential for abuse relative to the substances in Schedule III
466 and has a currently accepted medical use in treatment in the
467 United States, and abuse of the substance may lead to limited
468 physical or psychological dependence relative to the substances
469 in Schedule III. Unless specifically excepted or unless listed
470 in another schedule, any material, compound, mixture, or
471 preparation that which contains any quantity of the following
472 substances, including its salts, isomers, and salts of isomers
473 whenever the existence of such salts, isomers, and salts of
474 isomers is possible within the specific chemical designation,
475 are controlled in Schedule IV:
476 (a) Alprazolam.
477 (b) Barbital.
478 (c) Bromazepam.
479 (d) Camazepam.
480 (e) Cathine.
481 (f) Chloral betaine.
482 (g) Chloral hydrate.
483 (h) Chlordiazepoxide.
484 (i) Clobazam.
485 (j) Clonazepam.
486 (k) Clorazepate.
487 (l) Clotiazepam.
488 (m) Cloxazolam.
489 (n) Delorazepam.
490 (o) Propoxyphene (dosage forms).

542 (kkk) Zopiclone.
543 (lll) Zaleplon.
544 (mmm) Zolpidem.
545 (nnn) Modafinil.
546 (ooo) Petrichloral.
547 (ppp) Sibutramine.
548 (qqq) Dichloralphenazone.
549 (5) SCHEDULE V.—A substance, compound, mixture, or
550 preparation of a substance in Schedule V has a low potential for
551 abuse relative to the substances in Schedule IV and has a
552 currently accepted medical use in treatment in the United
553 States, and abuse of such compound, mixture, or preparation may
554 lead to limited physical or psychological dependence relative to
555 the substances in Schedule IV.
556 (b) Narcotic drugs. Unless specifically excepted or unless
557 listed in another schedule, any material, compound, mixture, or
558 preparation containing any of the following narcotic drugs and
559 their salts:
560 1. Buprenorphine.
561 2. Pregabalin.
562 3. Not more than 0.5 milligrams of Difenoxin and not less
563 than 25 micrograms of Atropine sulfate per dosage unit.
564 (c) Stimulants. Unless specifically excepted or unless
565 listed in another schedule, any material, compound, mixture, or
566 preparation that which contains any quantity of the following
567 substances having a stimulant effect on the central nervous
568 system, including its salts, isomers, and salts of isomers:
569 Pyrovalerone.
570 Section 2. This act shall take effect July 1, 2011.
