7 Be It Enacted by the Legislature of the State of Florida:

9 Section 1. Section 893.03, Florida Statutes, is amended to
10 read:
11 893.03 Standards and schedules.—The substances enumerated
12 in this section are controlled by this chapter. The controlled
13 substances listed or to be listed in Schedules I, II, III, IV,
14 and V are included by whatever official, common, usual,
15 chemical, or trade name designated. The provisions of this
16 section do shall not be construed to include within any of the
17 schedules contained in this section any excluded drugs listed
18 within the purview of 21 C.F.R. s. 1308.22, styled “Excluded
19 Substances”; 21 C.F.R. s. 1308.24, styled “Exempt Chemical
20 Preparations”; 21 C.F.R. s. 1308.32, styled “Exempted
21 Prescription Products”; or 21 C.F.R. s. 1308.34, styled “Exempt
22 Anabolic Steroid Products.”
23 (1) SCHEDULE I.—A substance in Schedule I has a high
24 potential for abuse and does not have any has no currently
25 accepted medical use in treatment in the United States and in
26 its use under medical supervision does not meet accepted safety
27 standards. The following substances are controlled in Schedule
28 I:
29 (a) Unless specifically excepted or unless listed in
30 another schedule, any of the following substances, including
31 their isomers, esters, ethers, salts, and salts of isomers,
32 esters, and ethers, whenever the existence of such isomers,
33 esters, ethers, and salts is possible within the specific
34 chemical designation:
35 1. Acetyl-alpha-methylfentanyl.
36 2. Acetylmethadol.
37 3. Allylprodine.
38 4. Alphacetylmethadol (except levo-alphacetylmethadol, also
39 known as levo-alpha-acetylmethadol, levomethadyl acetate, or
40 LAAM).
41 5. Alphamethadol.
42 6. Alpha-methylfentanyl (N-[1-(alpha-methyl-betaphenyl)
43 ethyl-4-piperidyl] propionanilide; 1-(1-methyl-2-phenylethyl)-4

179 specific chemical designation.
180 36. Salvinorin A, except for any drug product approved by
181 the United States Food and Drug Administration which contains
182 Salvinorin A or its isomers, esters, ethers, salts, and salts of
183 isomers, esters, and ethers, whenever the existence of such
184 isomers, esters, ethers, and salts is possible within the
185 specific chemical designation.
186 37. Tetrahydrocannabinols.
187 38. 1-[1-(2-Thienyl)-cyclohexyl]-piperidine (TCP)
188 (Thiophene analog of phencyclidine).
189 39. 3,4,5-Trimethoxyamphetamine.
190 40. Alpha-Methyltryptamine.
191 41. 1-(1-Phenylcyclohexyl) pyrrolidine.
192 42. 2,5-Dimethoxy-4-(n)-Propylthiophenethylamine.
193 43. 5-Methoxy-N, N-Diisopropyltryptamine.
194 44. N-Benzylpiperazine.
195 (d) Unless specifically excepted or unless listed in
196 another schedule, any material, compound, mixture, or
197 preparation that which contains any quantity of the following
198 substances, including any of its salts, isomers, optical
199 isomers, salts of their isomers, and salts of these optical
200 isomers whenever the existence of such isomers and salts is
201 possible within the specific chemical designation:
202 1. 1,4-Butanediol.
203 2. Gamma-butyrolactone (GBL).
204 3. Gamma-hydroxybutyric acid (GHB).
205 4. Methaqualone.
206 5. Mecloqualone.
207 (2) SCHEDULE II.—A substance in Schedule II has a high
208 potential for abuse and has a currently accepted but severely
209 restricted medical use in treatment in the United States, and
210 abuse of the substance may lead to severe psychological or
211 physical dependence. The following substances are controlled in
212 Schedule II:
213 (a) Unless specifically excepted or unless listed in
214 another schedule, any of the following substances, whether
215 produced directly or indirectly by extraction from substances of
216 vegetable origin or independently by means of chemical
217 synthesis:
218 1. Opium and any salt, compound, derivative, or preparation
219 of opium, except nalmefene or isoquinoline alkaloids of opium,
220 including, but not limited to the following:
221 a. Raw opium.
222 b. Opium extracts.
223 c. Opium fluid extracts.
224 d. Powdered opium.
225 e. Granulated opium.
226 f. Tincture of opium.
227 g. Codeine.
228 h. Ethylmorphine.
229 i. Etorphine hydrochloride.
230 j. Hydrocodone.
231 k. Hydromorphone.
232 l. Levo-alphacetylmethadol (also known as levo-alpha
233 acetylmethadol, levomethadyl acetate, or LAAM).
234 m. Metopon (methyldihydromorphinone).
235 n. Morphine.
236 o. Oxycodone.
237 p. Oxymorphone.
238 q. Thebaine.
239 r. Dihydroetorphine.
240 2. Any salt, compound, derivative, or preparation of a
241 substance which is chemically equivalent to or identical with
242 any of the substances referred to in subparagraph 1., except
243 that these substances shall not include the isoquinoline
244 alkaloids of opium.
245 3. Any part of the plant of the species Papaver somniferum,
246 L.
247 4. Cocaine or ecgonine, including any of their
248 stereoisomers, and any salt, compound, derivative, or
249 preparation of cocaine or ecgonine.
250 (b) Unless specifically excepted or unless listed in
251 another schedule, any of the following substances, including
252 their isomers, esters, ethers, salts, and salts of isomers,
253 esters, and ethers, whenever the existence of such isomers,
254 esters, ethers, and salts is possible within the specific
255 chemical designation:
256 1. Alfentanil.
257 2. Alphaprodine.
258 3. Anileridine.
259 4. Bezitramide.
260 5. Bulk propoxyphene (nondosage forms).
261 6. Carfentanil.
262 7. Dihydrocodeine.
263 8. Diphenoxylate.
264 9. Fentanyl.
265 10. Isomethadone.
266 11. Levomethorphan.
267 12. Levorphanol.
268 13. Metazocine.
269 14. Methadone.
270 15. Methadone-Intermediate,4-cyano-2-

292 (c) Unless specifically excepted or unless listed in
293 another schedule, any material, compound, mixture, or
294 preparation that which contains any quantity of the following
295 substances, including their salts, isomers, optical isomers,
296 salts of their isomers, and salts of their optical isomers:
297 1. Amobarbital.
298 2. Amphetamine.
299 3. Glutethimide.
300 4. Methamphetamine.
301 5. Methylphenidate.
302 6. Pentobarbital.
303 7. Phenmetrazine.
304 8. Phenylacetone.
305 9. Secobarbital.
306 (3) SCHEDULE III.—A substance in Schedule III has a
307 potential for abuse less than the substances contained in
308 Schedules I and II and has a currently accepted medical use in
309 treatment in the United States, and abuse of the substance may
310 lead to moderate or low physical dependence or high
311 psychological dependence or, in the case of anabolic steroids,
312 may lead to physical damage. The following substances are
313 controlled in Schedule III:
314 (a) Unless specifically excepted or unless listed in
315 another schedule, any material, compound, mixture, or
316 preparation that which contains any quantity of the following
317 substances having a depressant or stimulant effect on the
318 nervous system, including its salts, isomers, and salts of
319 isomers, whenever the existence of such salts, isomers, and
320 salts of isomers is possible within the specific chemical
321 designation:
322 1. Any substance that which contains any quantity of a
323 derivative of barbituric acid, including thiobarbituric acid, or
324 any salt of a derivative of barbituric acid or thiobarbituric
325 acid, including, but not limited to, butabarbital and
326 butalbital.
327 2. Benzphetamine.
328 3. Chlorhexadol.
329 4. Chlorphentermine.
330 5. Clortermine.
331 6. Lysergic acid.
332 7. Lysergic acid amide.
333 8. Methyprylon.
334 9. Phendimetrazine.
335 10. Sulfondiethylmethane.
336 11. Sulfonethylmethane.
337 12. Sulfonmethane.
338 13. Tiletamine and zolazepam or any salt thereof.
339 14. Embutramide.
340 (b) Nalorphine.
341 (c) Unless specifically excepted or unless listed in
342 another schedule, any material, compound, mixture, or
343 preparation containing limited quantities of any of the
344 following controlled substances or any salts thereof:
345 1. Not more than 1.8 grams of codeine per 100 milliliters
346 or not more than 90 milligrams per dosage unit, with an equal or
347 greater quantity of an isoquinoline alkaloid of opium.
348 2. Not more than 1.8 grams of codeine per 100 milliliters
349 or not more than 90 milligrams per dosage unit, with recognized
350 therapeutic amounts of one or more active ingredients that which
351 are not controlled substances.
352 3. Not more than 300 milligrams of hydrocodone per 100
353 milliliters or not more than 15 milligrams per dosage unit, with
354 a fourfold or greater quantity of an isoquinoline alkaloid of
355 opium.
356 4. Not more than 300 milligrams of hydrocodone per 100
357 milliliters or not more than 15 milligrams per dosage unit, with
358 recognized therapeutic amounts of one or more active ingredients
359 that are not controlled substances.
360 5. Not more than 1.8 grams of dihydrocodeine per 100
361 milliliters or not more than 90 milligrams per dosage unit, with
362 recognized therapeutic amounts of one or more active ingredients
363 that which are not controlled substances.
364 6. Not more than 300 milligrams of ethylmorphine per 100
365 milliliters or not more than 15 milligrams per dosage unit, with
366 one or more active, nonnarcotic ingredients in recognized
367 therapeutic amounts.
368 7. Not more than 50 milligrams of morphine per 100
369 milliliters or per 100 grams, with recognized therapeutic
370 amounts of one or more active ingredients that which are not
371 controlled substances.

373 For purposes of charging a person with a violation of s. 893.135
374 involving any controlled substance described in subparagraph 3.
375 or subparagraph 4., the controlled substance is a Schedule III
376 controlled substance pursuant to this paragraph but the weight
377 of the controlled substance per milliliters or per dosage unit
378 is not relevant to the charging of a violation of s. 893.135.
379 The weight of the controlled substance shall be determined
380 pursuant to s. 893.135(6).
381 (d) Anabolic steroids.
382 1. The term “anabolic steroid” means any drug or hormonal
383 substance, chemically and pharmacologically related to
384 testosterone, other than estrogens, progestins, and
385 corticosteroids, that promotes muscle growth and includes:
386 a. Androsterone.
387 b. Androsterone acetate.
388 c. Boldenone.
389 d. Boldenone acetate.
390 e. Boldenone benzoate.
391 f. Boldenone undecylenate.
392 g. Chlorotestosterone (4-chlortestosterone).
393 h. Clostebol.
394 i. Dehydrochlormethyltestosterone.
395 j. Dihydrotestosterone (4-dihydrotestosterone).
396 k. Drostanolone.
397 l. Ethylestrenol.
398 m. Fluoxymesterone.
399 n. Formebulone (formebolone).
400 o. Mesterolone.
401 p. Methandienone.
402 q. Methandranone.
403 r. Methandriol.
404 s. Methandrostenolone.
405 t. Methenolone.
406 u. Methyltestosterone.
407 v. Mibolerone.
408 w. Nandrolone.
409 x. Norethandrolone.
410 y. Nortestosterone.
411 z. Nortestosterone decanoate.
412 aa. Nortestosterone phenylpropionate.

428 qq. Testosterone phenylpropionate.
429 rr. Testosterone propionate.
430 ss. Testosterone undecanoate.
431 tt. Trenbolone.
432 uu. Trenbolone acetate.
433 vv. Any salt, ester, or isomer of a drug or substance
434 described or listed in this subparagraph if that salt, ester, or
435 isomer promotes muscle growth.
436 2. The term does not include an anabolic steroid that is
437 expressly intended for administration through implants to cattle
438 or other nonhuman species and that has been approved by the
439 United States Secretary of Health and Human Services for such
440 administration. However, any person who prescribes, dispenses,
441 or distributes such a steroid for human use is considered to
442 have prescribed, dispensed, or distributed an anabolic steroid
443 within the meaning of this paragraph.
444 (e) Ketamine, including any isomers, esters, ethers, salts,
445 and salts of isomers, esters, and ethers, whenever the existence
446 of such isomers, esters, ethers, and salts is possible within
447 the specific chemical designation.
448 (f) Dronabinol (synthetic THC) in sesame oil and
449 encapsulated in a soft gelatin capsule in a drug product
450 approved by the United States Food and Drug Administration.
451 (g) Any drug product containing gamma-hydroxybutyric acid,
452 including its salts, isomers, and salts of isomers, for which an
453 application is approved under s. 505 of the Federal Food, Drug,
454 and Cosmetic Act.
455 (4) SCHEDULE IV.—A substance in Schedule IV has a low
456 potential for abuse relative to the substances in Schedule III
457 and has a currently accepted medical use in treatment in the
458 United States, and abuse of the substance may lead to limited
459 physical or psychological dependence relative to the substances
460 in Schedule III. Unless specifically excepted or unless listed
461 in another schedule, any material, compound, mixture, or
462 preparation that which contains any quantity of the following
463 substances, including its salts, isomers, and salts of isomers
464 whenever the existence of such salts, isomers, and salts of
465 isomers is possible within the specific chemical designation,
466 are controlled in Schedule IV:
467 (a) Alprazolam.
468 (b) Barbital.
469 (c) Bromazepam.
470 (d) Camazepam.
471 (e) Cathine.
472 (f) Chloral betaine.
473 (g) Chloral hydrate.
474 (h) Chlordiazepoxide.
475 (i) Clobazam.
476 (j) Clonazepam.
477 (k) Clorazepate.
478 (l) Clotiazepam.
479 (m) Cloxazolam.
480 (n) Delorazepam.
481 (o) Propoxyphene (dosage forms).
482 (p) Diazepam.
483 (q) Diethylpropion.
484 (r) Estazolam.

529 (hhh) Not more than 1 milligram of difenoxin and not less
530 than 25 micrograms of atropine sulfate per dosage unit.
531 (iii) Butorphanol tartrate.
532 (jjj) Carisoprodol.
533 (kkk) Zopiclone.
534 (lll) Zaleplon.
535 (mmm) Zolpidem.
536 (nnn) Modafinil.
537 (ooo) Petrichloral.
538 (ppp) Sibutramine.
539 (qqq) Dichloralphenazone.
540 (5) SCHEDULE V.—A substance, compound, mixture, or
541 preparation of a substance in Schedule V has a low potential for
542 abuse relative to the substances in Schedule IV and has a
543 currently accepted medical use in treatment in the United
544 States, and abuse of such compound, mixture, or preparation may
545 lead to limited physical or psychological dependence relative to
546 the substances in Schedule IV.
547 (b) Narcotic drugs. Unless specifically excepted or unless
548 listed in another schedule, any material, compound, mixture, or
549 preparation containing any of the following narcotic drugs and
550 their salts:
551 1. Buprenorphine.
552 2. Pregabalin.
553 3. Not more than 0.5 milligrams of Difenoxin and not less
554 than 25 micrograms of Atropine sulfate per dosage unit.
555 (c) Stimulants. Unless specifically excepted or unless
556 listed in another schedule, any material, compound, mixture, or
557 preparation that which contains any quantity of the following
558 substances having a stimulant effect on the central nervous
559 system, including its salts, isomers, and salts of isomers:
560 Pyrovalerone.
561 Section 2. This act shall take effect July 1, 2011.
