1	A bill to be entitled
2	An act relating to public school education; requiring the
3	Florida Comprehensive Assessment Test (FCAT) in reading
4	for grade 3 students to be administered as a diagnostic
5	tool; providing that performance on grade 3 FCAT Reading
6	must not be the sole determining factor for retention of
7	grade 3 students; providing an effective date.

9	Be It Enacted by the Legislature of the State of Florida:

11	Section 1.  Notwithstanding ss. 1008.22 and 1008.25,
12	Florida Statutes, and any other provision of law to the
13	contrary, the Florida Comprehensive Assessment Test (FCAT) in
14	reading for grade 3 students shall be administered as a
15	diagnostic tool to assess a student's reading proficiency. A
16	student in grade 3 who does not earn a passing score on grade 3
17	FCAT Reading must not be retained in grade 3 based solely on his
18	or her performance on FCAT Reading. The school site
19	administrator and the student's teacher, in consultation with
20	the student's parent, shall make the determination as to the
21	student's promotion or retention.
22	Section 2.  This act shall take effect July 1, 2011.
