9 | Be It Enacted by the Legislature of the State of Florida: |

11 | Section 1. Subsection (4) of section 1003.455, Florida |
12 | Statutes, is amended to read: |
13 | 1003.455 Physical education; assessment.- |
14 | (4) The physical education requirement in subsection (3) |
15 | shall be waived for a student who meets one of the following |
16 | criteria: |
17 | (a) The student is enrolled or required to enroll in a |
18 | remedial course. |
19 | (b) The student's parent indicates in writing to the |
20 | school that: |
21 | 1. The parent requests that the student enroll in another |
22 | course from among those courses offered as options by the school |
23 | district; or |
24 | 2. the student is participating in physical activities |
25 | outside the school day which are equal to or in excess of the |
26 | mandated requirement. |
27 | (c) The student submits to the school's administration a |
28 | doctor's note that specifies the health reasons as to why the |
29 | student should not participate in physical education. |
30 | Section 2. This act shall take effect July 1, 2011. |
