A bill to be entitled
2An act relating to obscenity; amending s. 847.001, F.S.;
3revising the definition of the term "sexual conduct" for
4purposes of provisions relating to obscenity to include
5certain forms of simulated conduct; providing an effective
6date.

8Be It Enacted by the Legislature of the State of Florida:

10     Section 1.  Subsection (16) of section 847.001, Florida
11Statutes, is amended to read:
12     847.001  Definitions.-As used in this chapter, the term:
13     (16)  "Sexual conduct" means actual or simulated sexual
14intercourse, deviate sexual intercourse, sexual bestiality,
15masturbation, or sadomasochistic abuse; actual or simulated lewd
16exhibition of the genitals; actual or simulated physical contact
17with a person's clothed or unclothed genitals, pubic area,
18buttocks, or, if such person is a female, breast with the intent
19to arouse or gratify the sexual desire of either party; or any
20actual or simulated act or conduct which constitutes sexual
21battery or simulates that sexual battery is being or will be
22committed. A mother's breastfeeding of her baby does not under
23any circumstance constitute "sexual conduct."
24     Section 2.  This act shall take effect July 1, 2011.
