The Committee on Community Affairs (Ring) recommended the
following:
1 Senate Amendment (with title amendment)

3 Delete everything after the enacting clause
4 and insert:
5 Section 1. This act may be cited as the “Buy Florida Act.”
6 Section 2. Section 283.35, Florida Statutes, is amended to
7 read:
8 283.35 Preference given printing within the state.—Every
9 agency, county, municipality, school district, or other
10 political subdivision of this state shall give preference to the
11 responsible and responsive vendor whose principal place of
12 business is in this state and who is offering the lowest-priced
13 bid or highest-ranked proposal or reply, vendors located within
14 the state when awarding contracts to have materials printed.,
15 whenever such printing can be done at no greater expense than
16 the expense of awarding a contract to a vendor located outside
17 the state and can be done at a level of quality comparable to
18 that obtainable from a vendor located outside the state. The
19 preference shall be 5 percent.
20 Section 3. Section 287.084, Florida Statutes, is amended to
21 read:
22 287.084 Preference to Florida businesses.—
23 (1) When an agency, county, municipality, school district,
24 or other political subdivision of the state is required to make
25 purchases of personal property through competitive solicitation
26 and the responsive lowest-priced bid or responsive highest
27 ranked lowest responsible and responsive bid, proposal, or reply
28 is by a responsible vendor whose principal place of business is
29 in a state other than this state or political subdivision
30 thereof which grants a preference for the purchase of such
31 personal property to a person whose principal place of business
32 is in such state, then the agency, county, municipality, school
33 district, or other political subdivision of this state shall may
34 award a preference to the lowest responsible and responsive
35 vendor offering the lowest-priced bid or highest-ranked proposal
36 or reply having a principal place of business within this
37 state., which preference is equal to the preference granted by
38 the state or political subdivision thereof in which the lowest
39 responsible and responsive vendor has its principal place of
40 business. The preference given shall be 5 percent. However, this
41 section does not apply to transportation projects for which
42 federal aid funds are available.
43 (2) If a solicitation provides for the granting of such
44 preference as is provided in this section, Any vendor whose
45 principal place of business is outside the State of Florida must
46 accompany any written bid, proposal, or reply documents with a
47 written opinion of an attorney at law licensed to practice law
48 in that foreign state, as to the preferences, if any or none,
49 granted by the law of that state to its own business entities
50 whose principal places of business are in that foreign state in
51 the letting of any or all public contracts.
52 Section 4. This act shall take effect July 1, 2011.

59 An act relating to preference to Florida businesses in
60 procurement of personal property and services;
61 providing a short title; amending s. 283.35, F.S.;
62 requiring an agency, county, municipality, school
63 district, or other political subdivision of the state
64 to grant a specified preference to a vendor located
65 within the state when awarding a contract for printing
66 under certain circumstances; specifying the percentage
67 of preference to be granted; amending s. 287.084,
68 F.S.; requiring, rather than authorizing, an agency,
69 county, municipality, school district, or other
70 political subdivision of the state in making purchases
71 of personal property through competitive solicitation
72 to award a preference to a responsible and responsive
73 vendor having a principal place of business within
74 this state under specified circumstances; specifying
75 the percentage of preference to be granted; deleting a
76 provision to conform to changes made by the act;
77 providing an effective date.
