A bill to be entitled
2An act relating to conceptual permits for urban
3redevelopment projects; creating s. 373.4131, F.S.;
4authorizing certain municipalities and counties to adopt
5stormwater adaptive management plans and obtain conceptual
6permits for urban redevelopment projects; providing
7requirements for establishment of such permits by water
8management districts in consultation with the Department
9of Environmental Protection; providing that certain urban
10redevelopment projects qualify for a noticed general
11permit; providing an effective date.

13Be It Enacted by the Legislature of the State of Florida:

15     Section 1.  Section 373.4131, Florida Statutes, is created
16to read:
17     373.4131  Conceptual permits for urban redevelopment
18projects.-
19     (1)  A municipality or county that has created a community
20redevelopment area or an urban infill and redevelopment area
21pursuant to chapter 163 may adopt a stormwater adaptive
22management plan that addresses the quantity and quality of
23stormwater discharges for the redevelopment or infill area and
24may obtain a conceptual permit from the water management
25district or the Department of Environmental Protection.
26     (2)  The conceptual permit established by a water
27management district in consultation with the department:
28     (a)  Must allow for the rate and volume of stormwater
29discharges for stormwater management systems of urban
30redevelopment projects located within a community redevelopment
31area created under part III of chapter 163 or an urban infill
32and redevelopment area designated under s. 163.2517 to continue
33up to the maximum rate and volume of stormwater discharges
34within the area as of the date the stormwater adaptive
35management plan was adopted.
36     (b)  Must presume that stormwater discharges for stormwater
37management systems of urban redevelopment projects located
38within a community redevelopment area created under part III of
39chapter 163 or an urban infill and redevelopment area designated
40under s. 163.2517 that demonstrate a net improvement of the
41quality of the discharged water that existed as of the date the
42stormwater adaptive management plan was adopted for any
43applicable pollutants of concern in the receiving water body do
44not cause or contribute to violations of water quality criteria.
45     (c)  May not prescribe additional or more stringent
46limitations concerning the quantity and quality of stormwater
47discharges from stormwater management systems than provided in
48this section.
49     (d)  Shall be issued for a duration of 20 years, unless a
50shorter duration is requested by the applicant.
51     (3)  Urban redevelopment projects that meet the criteria
52established in the conceptual permit pursuant to this section
53qualify for a noticed general permit that authorizes
54construction and operation for the duration of the conceptual
55permit.
56     Section 2.  This act shall take effect July 1, 2011.
