Senator Bennett moved the following:

3 Delete lines 134 - 207
4 and insert:
5 constructed to comply with a sustainable building rating or a
6 national model green building code the United States Green
7 Building Council (USGBC) Leadership in Energy and Environmental
8 Design (LEED) rating system, the Green Building Initiative’s
9 Green Globes rating system, the Florida Green Building Coalition
10 standards, or a nationally recognized, high-performance green
11 building rating system as approved by the department. It is
12 further the policy of the state, if when economically feasible,
13 to retrofit existing state-owned buildings in a manner that
14 minimizes which will minimize the consumption of energy used in
15 the operation and maintenance of such buildings.
16 (4) In addition to designing and constructing new buildings
17 to be energy-efficient, it is shall be the policy of the state
18 to operate and maintain state facilities in a manner that
19 minimizes which will minimize energy consumption and maximizes
20 maximize building sustainability, and to operate as well as
21 ensure that facilities leased by the state are operated so as to
22 minimize energy use. It is further the policy of the state that
23 the renovation of existing state facilities be in accordance
24 with a sustainable building rating or a national model green
25 building code the United States Green Building Council (USGBC)
26 Leadership in Energy and Environmental Design (LEED) rating
27 system, the Green Building Initiative’s Green Globes rating
28 system, the Florida Green Building Coalition standards, or a
29 nationally recognized, high-performance green building rating
30 system as approved by the department. State agencies are
31 encouraged to consider shared savings financing of such energy
32 efficiency and conservation projects, using contracts that which
33 split the resulting savings for a specified period of time
34 between the state agency and the private firm or cogeneration
35 contracts and that which otherwise permit the state to lower its
36 net energy costs. Such energy contracts may be funded from the
37 operating budget.
38 Section 4. Subsection (7) of section 255.253, Florida
39 Statutes, is amended to read:
40 255.253 Definitions; ss. 255.251-255.258.—
41 (7) “Sustainable building rating or national model green
42 building code” means a rating system established by the United
43 States Green Building Council (USGBC) Leadership in Energy and
44 Environmental Design (LEED) rating system, the International
45 Green Construction Code (IGCC), the Green Building Initiative’s
46 Green Globes rating system, the Florida Green Building Coalition
47 standards, or a nationally recognized, high-performance green
48 building rating system as approved by the department.
49 Section 5. Subsection (4) of section 255.257, Florida
50 Statutes, is amended to read:
51 255.257 Energy management; buildings occupied by state
52 agencies.—
53 (4) ADOPTION OF STANDARDS.—
54 (a) All state agencies shall adopt a sustainable building
55 rating system or use a national model green building code the
56 United States Green Building Council (USGBC) Leadership in
57 Energy and Environmental Design (LEED) rating system, the Green
58 Building Initiative’s Green Globes rating system, the Florida
59 Green Building Coalition standards, or a nationally recognized,
60 high-performance green building rating system as approved by the
61 department for all new buildings and renovations to existing
62 buildings.
63 (b) No state agency shall enter into new leasing agreements
64 for office space that does not meet Energy Star building
65 standards, except when determined by the appropriate state
66 agency head determines that no other viable or cost-effective
67 alternative exists.
68 (c) All state agencies shall develop energy conservation
69 measures and guidelines for new and existing office space where
70 state agencies occupy more than 5,000 square feet. These
71 conservation measures shall focus on programs that may reduce
72 energy consumption and, when established, provide a net
73 reduction in occupancy costs.
74 Section 6. Subsection (2) of section 255.2575, Florida
75 Statutes, is amended to read:
76 255.2575 Energy-efficient and sustainable buildings.—
77 (2) All county, municipal, school district, water
78 management district, state university, community college, and
79 Florida state court buildings shall be constructed to comply
80 with a sustainable building rating system or a national model
81 green building code meet the United States

85 Delete lines 12 - 17
86 and insert:
87 255.253, F.S.; redefining the term “sustainable
88 building rating” and defining the term “national model
89 green building code” to include the International
90 Green Construction Code; amending ss. 255.257 and
91 255.2575, F.S.; requiring that state agencies, local
92 governments, and the court system adopt a sustainable
93 building rating system or national model green
