       The Committee on Community Affairs (Bennett) recommended the
       following:
       
    1         Senate Amendment to Amendment (460854) (with title
    2  amendment)
    3  
    4         Between lines 11 and 12
    5  insert:
    6         Section 2. Paragraph (a) of subsection (11) of section
    7  161.053, Florida Statutes, is amended to read:
    8         161.053 Coastal construction and excavation; regulation on
    9  county basis.—
   10         (11)(a) The coastal construction control requirements
   11  defined in subsection (1) and the requirements of the erosion
   12  projections in subsection (5) do not apply to any modification,
   13  maintenance, or repair of any existing structure within the
   14  limits of the existing foundation which does not require,
   15  involve, or include any additions to, or repair or modification
   16  of, the existing foundation of that structure. Specifically
   17  excluded from this exemption are seawalls or other rigid coastal
   18  or shore protection structures and any additions or enclosures
   19  added, constructed, or installed below the first dwelling floor
   20  or lowest deck of the existing structure. The Florida Building
   21  Commission may not adopt any rule having the effect of limiting
   22  any exceptions or exemptions contained within this subsection.
