       Senator Fasano moved the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Between lines 346 and 347
    4  insert:
    5         Section 9. The Department of Environmental Protection may
    6  not issue any permit for a Class I landfill that will be located
    7  within 5 miles of the Withlacoochee River and that will be
    8  located in the Northern Tampa Bay Water Use Caution Area
    9  designated by rule by the Southwest Florida Water Management
   10  District. This section applies to all applications for any Class
   11  I landfill permit submitted on or after January 1, 2006, for
   12  which the department has not issued a final permit.

   15         And the title is amended as follows:
   16         Delete line 51
   17  and insert:
   18         the exemption; prohibiting the Department of
   19         Environmental Protection from issuing a permit for a
   20         Class I landfill that will be located in a certain
   21         specified area; providing for application; providing
   22         an effective date.
