A bill to be entitled
2An act relating to preference in award of state contracts;
3amending s. 287.084, F.S.; expanding provisions that
4authorize an agency, county, municipality, school
5district, or other political subdivision of the state to
6provide preferential consideration to a Florida business
7in awarding competitively bid contracts to purchase
8personal property to include the purchase of construction
9services; providing that for specified competitive
10solicitations the authority to grant preference supersedes
11any local ordinance or regulation which grants preference
12to specified vendors; requiring a county, municipality,
13school district, or other political subdivision to make
14specified disclosures in competitive solicitation
15documents; providing construction; providing an effective
16date.

18Be It Enacted by the Legislature of the State of Florida:
19
20     Section 1.  Subsection (1) of section 287.084, Florida
21Statutes, is amended to read:
22     287.084  Preference to Florida businesses.-
23     (1)(a)  When an agency, county, municipality, school
24district, or other political subdivision of the state is
25required to make purchases of personal property or construction
26services through competitive solicitation and the lowest
27responsible and responsive bid, proposal, or reply is by a
28vendor whose principal place of business is in a state or
29political subdivision thereof which grants a preference for the
30purchase of such personal property or construction services to a
31person whose principal place of business is in such state, then
32the agency, county, municipality, school district, or other
33political subdivision of this state may award a preference to
34the lowest responsible and responsive vendor having a principal
35place of business within this state, which preference is equal
36to the preference granted by the state or political subdivision
37thereof in which the lowest responsible and responsive vendor
38has its principal place of business. However, this section does
39not apply to transportation projects for which federal aid funds
40are available.
41     (b)1.  For a competitive solicitation in which payment for
42the personal property or construction services is to be made in
43whole or in part from funds appropriated by the state, this
44section preempts and supersedes any local ordinance or
45regulation that grants preference to a vendor based upon:
46     a.  The vendor maintaining an office or place of business
47within a particular local jurisdiction;
48     b.  The vendor hiring employees or subcontractors from
49within a particular local jurisdiction; or
50     c.  The vendor's prior payment of local taxes, assessments,
51or duties within a particular local jurisdiction.
52     2.  In any competitive solicitation subject to this
53section, a county, municipality, school district, or other
54political subdivision shall disclose in the solicitation
55document whether payment will come from funds appropriated by
56the state and, if known, the amount of such funds or the
57percentage of such funds as compared to the anticipated total
58cost of the personal property or construction services.
59     3.  Except as provided in subparagraph 1., this section
60does not prevent a county, municipality, school district, or
61other political subdivision of this state from awarding a
62contract to any vendor in accordance with applicable state laws
63or local ordinances or regulations.
64     Section 2.  This act shall take effect July 1, 2011.
