4	Between lines 1334 and 1335, insert:
5	Section 59.  Section 489.1138, Florida Statutes, is created
6	to read:
7	489.1138  Preemption of regulation of hoisting equipment
8	used in construction, demolition, or excavation work.-
9	(1)  The regulation of cranes, derricks, hoists, elevators,
10	and conveyors used in construction, demolition, or excavation
11	work is preempted to the state and shall be regulated under the
12	federal rules adopted by the Occupational Safety and Health
13	Administration under 29 C.F.R. parts 1910 and 1926.
14	(2)  This section does not apply to the regulation of
15	elevators under chapter 399.
