A bill to be entitled
2An act relating to the Agency for Persons with
3Disabilities; amending s. 393.0661, F.S.; reducing the
4geographic differentials for residential habilitation
5services in certain counties; specifying that the agency
6shall pay a uniform reimbursement rate to all providers of
7companion care services and authorizing the agency to seek
8federal approval to amend current waivers to comply with
9that requirement; providing an effective date.

11Be It Enacted by the Legislature of the State of Florida:

13     Section 1.  Subsections (4) and (5) of section 393.0661,
14Florida Statutes, are amended, present subsection (8) is
15renumbered as subsection (9), and a new subsection (8) is added
16to that section, to read:
17     393.0661  Home and community-based services delivery
18system; comprehensive redesign.-The Legislature finds that the
19home and community-based services delivery system for persons
20with developmental disabilities and the availability of
21appropriated funds are two of the critical elements in making
22services available. Therefore, it is the intent of the
23Legislature that the Agency for Persons with Disabilities shall
24develop and implement a comprehensive redesign of the system.
25     (4)  The geographic differential for Miami-Dade, Broward,
26and Palm Beach Counties for residential habilitation services
27shall be 3.5 7.5 percent.
28     (5)  The geographic differential for Monroe County for
29residential habilitation services shall be 3.5 20 percent.
30     (8)  Beginning July 1, 2011, the agency shall pay a uniform
31reimbursement rate to all providers of companion care services.
32The rate shall be set by the agency. The agency is authorized to
33seek federal approval to amend current waivers in order to
34comply with this subsection.
35     Section 2.  This act shall take effect July 1, 2011.
