Floor: WD/2R . 05/04/2011 10:13 AM . ————————————————————————————————————————————————————————————————— ————————————————————————————————————————————————————————————————— Senator Lynn moved the following: 1 Senate Amendment (with title amendment) 2 3 Delete lines 23 - 53 4 and insert: 5 (1) The Department of Children and Family Services shall 6 require a drug test consistent with s. 112.0455 to randomly 7 screen individuals who apply for temporary assistance for needy 8 families (TANF). The cost of drug testing shall be the 9 responsibility of the individual. 10 (a) Individuals who are subject to the requirements of this 11 section include any parent or caretaker relative who is included 12 in the cash assistance group, including individuals who may be 13 exempt from work activity requirements due to the age of the 14 youngest child or who may be excepted from work activity 15 requirements under s. 414.065(4). 16 (b) An individual who tests positive for controlled 17 substances as a result of a drug test required under this 18 section is ineligible to receive TANF benefits for 1 year after 19 the date of the positive drug test unless the individual meets 20 the requirements of paragraph (2)(j). 21 (2) The department shall: 22 (a) Provide notice of random drug testing to each 23 individual at the time of application. The notice must advise 24 the individual that drug testing may be conducted as a condition 25 for receiving TANF benefits and that the individual must bear 26 the cost of testing. The individual shall be advised that the 27 drug testing may be avoided if the individual does not apply for 28 TANF benefits. Dependent children under the age of 18 are exempt 29 from the drug testing. 30 (b) Require that for two-parent families, both parents must 31 comply with the drug testing if the parents are randomly chosen 32 to undergo the testing. 33 (c) Require that any teen parent who is not required to 34 live with a parent, legal guardian, or other adult caretaker 35 relative in accordance with s. 414.095(14)(c) must comply with 36 the drug testing if the teen parent is randomly chosen to 37 undergo the testing. 38 39 ================= T I T L E A M E N D M E N T ================ 40 And the title is amended as follows: 41 42 Delete lines 3 - 5 43 and insert: 44 Families Program; creating s. 414.145, F.S.; requiring 45 the Department of Children and Family Services to 46 perform a random drug test on individuals who apply 47 for
