Senator Lynn moved the following:

4 insert:
5 Section 2. Subsection (4) and paragraph (g) of subsection
6 (5) of section 112.0455, Florida Statutes, are amended to read:
7 112.0455 Drug-Free Workplace Act.—
8 (4) NO LEGAL DUTY TO TEST.—All drug testing conducted by
9 employers shall be in conformity with the standards established
10 in this section and all applicable rules promulgated pursuant to
11 this section. Notwithstanding any other law However, employers
12 shall not have a legal duty under this section to request an
13 employee or job applicant to undergo drug testing. No Testing of
14 employees shall not take effect until local drug abuse
15 assistance programs have been identified.
16 (5) DEFINITIONS.—Except where the context otherwise
17 requires, as used in this act:
18 (g) “Employee” means any person who works for salary,
19 wages, or other remuneration for an employer and includes any
20 state-elected official.
