A bill to be entitled
2An act relating to the Public Employees Relations
3Commission; amending s. 447.205, F.S.; requiring the
4commission to be comprised of a chair and two part-time
5members; requiring the chair of the commission to devote
6full time to commission duties and not engage in any other
7business, vocation, or employment while in such office;
8prohibiting the part-time members from engaging in any
9business, vocation, or employment that conflicts with
10their duties while in such office; providing an effective
11date.

13Be It Enacted by the Legislature of the State of Florida:

15     Section 1.  Subsection (1) of section 447.205, Florida
16Statutes, is amended to read:
17     447.205  Public Employees Relations Commission.-
18     (1)  The Public Employees Relations Commission, hereinafter
19referred to as the "commission," shall be composed of a chair
20and two part-time full-time members to be appointed by the
21Governor, subject to confirmation by the Senate, from persons
22representative of the public and known for their objective and
23independent judgment, who shall not be employed by, or hold any
24commission with, any governmental unit in the state or any
25employee organization, as defined in this part, while in such
26office. In no event shall more than one appointee be a person
27who, on account of previous vocation, employment, or
28affiliation, is, or has been, classified as a representative of
29employers; and in no event shall more than one such appointee be
30a person who, on account of previous vocation, employment, or
31affiliation, is, or has been, classified as a representative of
32employees or employee organizations. The chair of the commission
33commissioners shall devote full time to commission duties and
34shall not engage in any other business, vocation, or employment
35while in such office. The part-time members shall not engage in
36any business, vocation, or employment that conflicts with their
37duties while in such office. Beginning January 1, 1980, the
38chair shall be appointed for a term of 4 years, one commissioner
39for a term of 1 year, and one commissioner for a term of 2
40years. Thereafter, every term of office shall be for 4 years;
41and each term of the office of chair shall commence on January 1
42of the second year following each regularly scheduled general
43election at which a Governor is elected to a full term of
44office. In the event of a vacancy prior to the expiration of a
45term of office, an appointment shall be made for the unexpired
46term of that office. The chair shall be responsible for the
47administrative functions of the commission and shall have the
48authority to employ such personnel as may be necessary to carry
49out the provisions of this part. Once appointed to the office of
50chair, the chair shall serve as chair for the duration of the
51term of office of chair. Nothing contained herein prohibits a
52chair or commissioner from serving multiple terms.
53     Section 2.  This act shall take effect July 1, 2011.
