       The Committee on Judiciary (Simmons) recommended the following:
       
    1         Senate Amendment to Substitute Amendment (891718) (with
    2  ballot and title amendments)
    3  
    4         Delete lines 36 - 51
    5  and insert:
    6  changed annually on January 1 1st of each year. A change in an
    7  assessment may; but those changes in assessments shall not
    8  exceed the lower of the following:
    9         a. Three percent (3%) of the assessment for the prior year.
   10         b. The percent change in the Consumer Price Index for all
   11  urban consumers, U.S. City Average, all items 1967=100, or a
   12  successor index reports for the preceding calendar year as
   13  initially reported by the United States Department of Labor,
   14  Bureau of Labor Statistics.

   17  and insert:
   18         percent (10%) of the assessment for the prior year.

   20         Delete lines 166 - 170
   21  and insert:
   22  percent (10%) of the assessment for the prior year.
