House . . . . . ————————————————————————————————————————————————————————————————— ————————————————————————————————————————————————————————————————— Senator Ring moved the following: 1 Senate Amendment 2 3 Delete lines 236 - 270 4 and insert: 5 chapter 550, chapter 551, or chapter 849 or rules adopted by the 6 department. Such rules must be uniform in their application and 7 effect, and the duty of exercising this control and power is 8 made mandatory upon the department. 9 (f) The department may take testimony concerning any matter 10 within its jurisdiction and issue summons and subpoenas for any 11 witness and subpoenas duces tecum in connection with any matter 12 within the jurisdiction of the department under its seal and 13 signed by the director. 14 (g) In addition to the power to exclude certain persons 15 from any pari-mutuel facility in this state, the department may 16 exclude any person from any and all gaming establishments under 17 the jurisdiction of the department in this state for conduct 18 that would constitute, if the person were a licensee, a 19 violation of chapter 550, chapter 551, or chapter 849 or the 20 rules of the department. The department may exclude from any 21 gaming establishment under its jurisdiction within this state 22 any person who has been ejected from a pari-mutuel facility or 23 other gaming establishment in this state or who has been 24 excluded from any pari-mutuel facility or other gaming 25 establishment in another state by the governmental department, 26 agency, commission, or authority exercising regulatory 27 jurisdiction over such facilities in such other state. The 28 department may authorize any person who has been ejected or 29 excluded from establishments in this state or another state to 30 enter such facilities in this state upon a finding that the 31 attendance of such person would not be adverse to the public 32 interest or to the integrity of the industry; however, this 33 subsection shall not be construed to abrogate the common-law 34 right of a pari-mutuel permitholder or a proprietor of a gaming 35 establishment to exclude absolutely a patron in this state. 36 (h) The department may collect taxes and require compliance 37 with reporting requirements for financial information as 38 authorized by chapter 550, chapter 551, or chapter 849.
