1 A bill to be entitled
2 An act relating to trust funds; creating the Florida
3 Gaming Trust Fund within the Department of Gaming
4 Control; providing the funding sources and purpose of
5 the trust fund; requiring funds to remain in the trust
6 fund at the end of each fiscal year; providing for
7 future review and termination or re-creation of the
8 trust fund; providing a contingent effective date.

10 Be It Enacted by the Legislature of the State of Florida:

12 Section 1. Florida Gaming Trust Fund.—
13 (1) The Florida Gaming Trust Fund is created within the
14 Department of Gaming Control. Moneys deposited into the fund
15 shall be those collected from sources designated by state law.
16 The purpose of the trust fund is to provide funding for the
17 regulation of skill-based machine gaming and slot machine
18 gaming.
19 (2) Notwithstanding s. 216.301, Florida Statutes, and
20 pursuant to s. 216.351, Florida Statutes, any balance in the
21 trust fund at the end of any fiscal year shall remain in the
22 trust fund at the end of the fiscal year and shall be available
23 for carrying out the purposes of the trust fund.
24 (3) In accordance with s. 19(f)(2), Article III of the
25 State Constitution, the Florida Gaming Trust Fund shall, unless
26 terminated sooner, be terminated on July 1, 2015. Before its
27 scheduled termination, the trust fund must be reviewed as
28 provided in s. 215.3206(1) and (2), Florida Statutes.
29 Section 2. This act shall take effect July 1, 2011, if SB
30 666, or similar legislation creating the Gaming Commission and
31 the Department of Gaming Control, is adopted in the same
32 legislative session or an extension thereof and becomes law.
