    1                        A bill to be entitled                      
    2         An act relating to nursing home quality and licensure
    3         status; amending s. 400.235, F.S.; deleting a criteria
    4         for recognition as a Gold Seal Program facility;
    5         providing an effective date.

    7  Be It Enacted by the Legislature of the State of Florida:
    8  
    9         Section 1. Paragraph (g) of subsection (5) of section
   10  400.235, Florida Statutes, is redesignated as paragraph (f) and
   11  present paragraph (f) of that subsection is amended to read:
   12         400.235 Nursing home quality and licensure status; Gold
   13  Seal Program.—
   14         (5) Facilities must meet the following additional criteria
   15  for recognition as a Gold Seal Program facility:
   16         (f) Evidence an outstanding record regarding the number and
   17  types of substantiated complaints reported to the State Long
   18  Term Care Ombudsman Council within the 30 months preceding
   19  application for the program.

   21  A facility assigned a conditional licensure status may not
   22  qualify for consideration for the Gold Seal Program until after
   23  it has operated for 30 months with no class I or class II
   24  deficiencies and has completed a regularly scheduled relicensure
   25  survey.
   26         Section 2. This act shall take effect July 1, 2011.
