Florida Senate - 2011 SB 698 By Senator Richter 37-00810-11 2011698__ 1 A bill to be entitled 2 An act relating to assisted living facilities; 3 amending s. 429.178, F.S.; removing a provision that 4 exempts an assisted living facility that provides 5 special care for persons with Alzheimer’s disease or 6 other related disorders from the requirement to pay 7 for certain training and education programs; providing 8 an effective date. 9 10 Be It Enacted by the Legislature of the State of Florida: 11 12 Section 1. Subsection (8) of section 429.178, Florida 13 Statutes, is renumbered as subsection (7), and present 14 subsection (8) of that section is amended to read: 15 429.178 Special care for persons with Alzheimer’s disease 16 or other related disorders.— 17(7) Any facility more than 90 percent of whose residents18receive monthly optional supplementation payments is not19required to pay for the training and education programs required20under this section. A facility that has one or more such21residents shall pay a reduced fee that is proportional to the22percentage of such residents in the facility. A facility that23does not have any residents who receive monthly optional24supplementation payments must pay a reasonable fee, as25established by the department, for such training and education26programs.27 Section 2. This act shall take effect July 1, 2011.
