5 | 1. Returned to the wholesale distributor, as defined in s. |
6 | 499.003, Florida Statutes, which distributed them, with a |
7 | written certification by the physician that, from the time such |
8 | products were received by the physician until they are received |
9 | by the wholesale distributor, the products have been properly |
10 | stored, handled, and shipped in accordance with all applicable |
11 | laws, rules, regulations, and standards; and that the specific |
12 | units being returned were purchased from the wholesale |
13 | distributor; and identifying the corresponding sales invoice |
14 | number and date of sale from that wholesale distributor; or |
15 | 2. Turned in to local law enforcement agencies and |
16 | abandoned. |
17 | (b) Wholesale distributors shall buy back the undispensed |
18 | inventory of controlled substances listed in Schedule II or |
19 | Schedule III as provided in s. 893.03, Florida Statutes, at the |
20 | purchase price paid by the physician, physician practice, |
21 | clinic, or other paying entity. A wholesale distributor may |
22 | resell the inventory bought back under this section without |
23 | documenting the original sale or return in the pedigree paper. |
24 | Each wholesale distributor shall submit a report of its buy-back |
25 | activities under this section to the Department of Health by |
26 | August 1, 2011. The report shall include the following |
