       Senator Siplin moved the following:
       
    1         Senate Amendment to Amendment (351842) (with title
    2  amendment)
    3  
    4         Between lines 3971 and 3972
    5  insert:
    6         Section 36. Subsection (8) is added to section 400.023,
    7  Florida Statutes, to read:
    8         400.023 Civil enforcement.—
    9         (8) Notwithstanding any other provision of law, noneconomic
   10  damages may not exceed a total of $500,000 per resident
   11  regarding a cause of action for wrongful death brought under
   12  this part which arises from a claim for violation of a
   13  resident’s rights or negligence when providing services and care
   14  to Medicaid recipients as defined in s. 409.901.

   18         Delete line 4171
   19  and insert:
   20         solvency requirements; amending s. 400.023, F.S.;
   21         providing a limit on noneconomic damages for a cause
   22         for wrongful death brought under part II of ch. 400,
   23         F.S., which arises from a claim for violation of a
   24         resident’s rights or negligence when providing
   25         services and care to Medicaid recipients; providing
   26         for severablity
