       Senator Siplin moved the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Between lines 546 and 547
    4  insert:
    5         Section 3. Subsection (8) is added to section 400.023,
    6  Florida Statutes, to read:
    7         400.023 Civil enforcement.—
    8         (8) Notwithstanding any other provision of law, noneconomic
    9  damages may not exceed a total of $500,000 per resident
   10  regarding a cause of action for wrongful death brought under
   11  this part which arises from a claim for violation of a
   12  resident’s rights or negligence when providing services and care
   13  to Medicaid recipients as defined in s. 409.901.

   18  and insert:
   19         section on a specified date; amending s. 400.023,

   22         400, F.S., which arises from a claim for violation of
   23         a resident’s rights or negligence when providing
   24         services and care to Medicaid recipients; amending s.
   25         408.040, F.S.;
