       Senators Fasano and Latvala moved the following:
       
    1         Senate Amendment to Amendment (195750) (with title
    2  amendment)

    4         Between lines 9395 and 9396
    5  insert:
    6         Section 73. The Department of Environmental Protection may
    7  not issue any permit for a Class I landfill that will be located
    8  within 5 miles of the Withlacoochee River and that will be
    9  located in the Northern Tampa Bay Water Use Caution Area
   10  designated by rule by the Southwest Florida Water Management
   11  District. This section applies to all applications for any Class
   12  I landfill permit submitted on or after January 1, 2006, for
   13  which the department has not issued a final permit.

   16         And the title is amended as follows:
   17         Delete line 9730
   18  and insert:
   19         of surcharges for beach renourishment and restoration;
   20         prohibiting the Department of Environmental Protection
   21         from issuing a permit for a Class I landfill that will
   22         be located in a specified area; providing for
   23         application;
