| 5 | Section 2. Section 705.18, Florida Statutes, is amended to |
| 6 | read: |
| 7 | 705.18 Disposal of personal property lost or abandoned on |
| 8 | state university or Florida College System institution community |
| 9 | college campuses; disposition of proceeds from sale.- |
| 10 | (1) Whenever any lost or abandoned personal property, |
| 11 | except for lost or abandoned bicycles and bicycle safety |
| 12 | equipment, shall be found on a campus of an institution in the |
| 13 | State University System or the Florida College System a campus |
| 14 | of a state-supported community college, the president of the |
| 15 | institution or the president's designee shall take charge of the |
| 16 | property and make a record of the date such property was found. |
| 17 | If, within 30 days after such property is found, or a longer |
| 18 | period of time as may be deemed appropriate by the president or |
| 19 | designee under the circumstances, the property is not claimed by |
| 20 | the owner, the president or designee shall order it sold at |
| 21 | public outcry after giving notice of the time and place of sale |
| 22 | in a publication of general circulation on the campus of such |
| 23 | institution or by electronic posting on a clearly marked area of |
| 24 | the institution's Internet website and written notice to the |
| 25 | owner if known. The rightful owner of such property may reclaim |
| 26 | the same at any time prior to sale. |
| 27 | (2) All moneys realized from such institution's sale shall |
| 28 | be placed in an appropriate fund and used solely for student |
| 29 | scholarship and loan purposes. |
| 30 | (3) Whenever any lost or abandoned bicycles and bicycle |
| 31 | safety equipment shall be found on a campus of an institution in |
| 32 | the State University System or the Florida College System, the |
| 33 | president of the institution or the president's designee shall |
| 34 | take charge of the property and make a record of the date such |
| 35 | property was found. The president or designee shall publish |
| 36 | notification of lost or abandoned bicycles and bicycle safety |
| 37 | equipment in a manner to provide the most effective notice to |
| 38 | students, faculty, and staff of the institution, whether through |
| 39 | a publication of general circulation on the campus or by |
| 40 | electronic posting on a clearly marked area of the institution's |
| 41 | Internet website. If the owner of the property is known, written |
| 42 | notice to the owner shall be provided to the last known physical |
| 43 | or electronic address. If the property is not claimed by the |
| 44 | owner within 30 days after the publication, posting, or written |
| 45 | notification, the property may be retained by the institution |
| 46 | and made available for university transit-oriented initiatives |
| 47 | or sold pursuant to subsection (1) with the proceeds disposed of |
| 48 | pursuant to subsection (2). |
