A bill to be entitled
2An act relating to forest development; repealing chapter
3591, F.S., relating to the establishment and management of
4community forests by political subdivisions and school
5districts, the appointment of forestry committees, the use
6of revenues from such forests, and the sale of such
7forests; amending ss. 253.431, 570.548, and 604.15, F.S.,
8to conform; providing an effective date.

10Be It Enacted by the Legislature of the State of Florida:
11
12     Section 1.  Chapter 591, Florida Statutes, consisting of
13sections 591.15, 591.16, 591.17, 591.18, 591.19, 591.20, 591.21,
14591.22, 591.23, 591.24, 591.25, and 591.26, is repealed.
15     Section 2.  Section 253.431, Florida Statutes, is amended
16to read:
17     253.431  Agents may act on behalf of board of trustees.-The
18Board of Trustees of the Internal Improvement Trust Fund may, by
19resolution duly recorded in the records of said board, authorize
20or employ agents or employees to act in its behalf in the
21execution and delivery of deeds of conveyance, for the purpose
22of carrying into effect any exchange or contract or agreement
23therefor made by said board under or pursuant to the power
24vested in said board by this chapter, by virtue of the state's
25equity in lands under chapter 197, pursuant to conveyances by
26authority of s. 288.14 or chapter 270, by authority of s. 591.19
27or s. 285.14, and by such agents or employees issue disclaimers,
28releases of oil and mineral rights, quitclaim deeds, releases of
29any and all reservations of whatever kind in the lands of the
30state, and such other documents as may be authorized by the
31board to release or convey the state's interests. Any deed
32executed by said agents or employees shall fully convey to and
33vest in the purchaser or grantee the property so conveyed.
34     Section 3.  Section 570.548, Florida Statutes, is amended
35to read:
36     570.548  Division of Forestry; powers and duties.-The
37duties of the Division of Forestry include, but are not limited
38to, administering and enforcing those powers and
39responsibilities of the division prescribed in chapters 589 and,
40590, and 591 and the rules adopted pursuant thereto and in other
41forest fire, forest protection, and forest management laws of
42this state.
43     Section 4.  Subsections (5) through (10) of section 604.15,
44Florida Statutes, are renumbered as subsection (6) through (11),
45respectively, present subsection (1) is amended, and a new
46subsection (5) is added to that section, to read:
47     604.15  Dealers in agricultural products; definitions.-For
48the purpose of ss. 604.15-604.34, the following words and terms,
49when used, shall be construed to mean:
50     (1)  "Agricultural products" means the natural products of
51the farm, nursery, grove, orchard, vineyard, garden, and apiary
52(raw or manufactured); sod; tropical foliage; horticulture; hay;
53livestock; milk and milk products; poultry and poultry products;
54the fruit of the saw palmetto (meaning the fruit of the Serenoa
55repens); limes (meaning the fruit Citrus aurantifolia, variety
56Persian, Tahiti, Bearss, or Florida Key limes); and any other
57nonexempt agricultural products produced in the state, except
58tobacco, sugarcane, timber and timber byproducts, forest
59products as defined in s. 591.17, and citrus other than limes.
60     (5)  "Forest product" means any product produced from
61trees.
62     Section 5.  This act shall take effect July 1, 2011.
