3 | 591, F.S., relating to the establishment and management of |
4 | community forests by political subdivisions and school |
5 | districts, the appointment of forestry committees, the use |
6 | of revenues from such forests, and the sale of such |
7 | forests; amending ss. 253.431, 570.548, and 604.15, F.S., |
8 | to conform; providing an effective date. |

10 | Be It Enacted by the Legislature of the State of Florida: |
11 |
|
12 | Section 1. Chapter 591, Florida Statutes, consisting of |
13 | sections 591.15, 591.16, 591.17, 591.18, 591.19, 591.20, 591.21, |
14 | 591.22, 591.23, 591.24, 591.25, and 591.26, is repealed. |
15 | Section 2. Section 253.431, Florida Statutes, is amended |
16 | to read: |
17 | 253.431 Agents may act on behalf of board of trustees.-The |
18 | Board of Trustees of the Internal Improvement Trust Fund may, by |
19 | resolution duly recorded in the records of said board, authorize |
20 | or employ agents or employees to act in its behalf in the |
21 | execution and delivery of deeds of conveyance, for the purpose |
22 | of carrying into effect any exchange or contract or agreement |
23 | therefor made by said board under or pursuant to the power |
24 | vested in said board by this chapter, by virtue of the state's |
25 | equity in lands under chapter 197, pursuant to conveyances by |
26 | authority of s. 288.14 or chapter 270, by authority of s. 591.19 |
27 | or s. 285.14, and by such agents or employees issue disclaimers, |
28 | releases of oil and mineral rights, quitclaim deeds, releases of |
29 | any and all reservations of whatever kind in the lands of the |
30 | state, and such other documents as may be authorized by the |
31 | board to release or convey the state's interests. Any deed |
32 | executed by said agents or employees shall fully convey to and |
33 | vest in the purchaser or grantee the property so conveyed. |
34 | Section 3. Section 570.548, Florida Statutes, is amended |
35 | to read: |
36 | 570.548 Division of Forestry; powers and duties.-The |
37 | duties of the Division of Forestry include, but are not limited |
38 | to, administering and enforcing those powers and |
39 | responsibilities of the division prescribed in chapters 589 and, |
40 | 590, and 591 and the rules adopted pursuant thereto and in other |
41 | forest fire, forest protection, and forest management laws of |
42 | this state. |
43 | Section 4. Subsections (5) through (10) of section 604.15, |
44 | Florida Statutes, are renumbered as subsection (6) through (11), |
45 | respectively, present subsection (1) is amended, and a new |
46 | subsection (5) is added to that section, to read: |
47 | 604.15 Dealers in agricultural products; definitions.-For |
48 | the purpose of ss. 604.15-604.34, the following words and terms, |
49 | when used, shall be construed to mean: |
50 | (1) "Agricultural products" means the natural products of |
51 | the farm, nursery, grove, orchard, vineyard, garden, and apiary |
52 | (raw or manufactured); sod; tropical foliage; horticulture; hay; |
53 | livestock; milk and milk products; poultry and poultry products; |
54 | the fruit of the saw palmetto (meaning the fruit of the Serenoa |
55 | repens); limes (meaning the fruit Citrus aurantifolia, variety |
56 | Persian, Tahiti, Bearss, or Florida Key limes); and any other |
57 | nonexempt agricultural products produced in the state, except |
58 | tobacco, sugarcane, timber and timber byproducts, forest |
59 | products as defined in s. 591.17, and citrus other than limes. |
60 | (5) "Forest product" means any product produced from |
61 | trees. |
62 | Section 5. This act shall take effect July 1, 2011. |
