Florida Senate - 2011 (PROPOSED COMMITTEE BILL) SPB 7232 FOR CONSIDERATION By the Committee on Health Regulation 588-03087-11 20117232__ 1 A bill to be entitled 2 An act relating to the ratification of rules; 3 ratifying specified rules for the sole and exclusive 4 purpose of satisfying any condition on effectiveness 5 established by s. 120.541(3), F.S., which requires 6 ratification of any rule that meets any of the 7 specified thresholds that may likely have an adverse 8 impact or excessive regulatory cost; providing an 9 effective date. 10 11 Be It Enacted by the Legislature of the State of Florida: 12 13 Section 1. (1) The following rules are ratified for the 14 sole and exclusive purpose of satisfying any condition on 15 effectiveness imposed under s. 120.541(3), Florida Statutes: 16 (a) Rule 64B8-9.0134, Florida Administrative Code, relating 17 to the Maximum Number of Prescriptions in Registered Pain 18 Management Clinics, for the Board of Medicine. 19 (b) Rule 64B15-14.0054, Florida Administrative Code, 20 relating to the Maximum Number of Prescriptions in Registered 21 Pain-Management Clinics, for the Board of Osteopathic Medicine. 22 (2) This act serves no other purpose and shall not be 23 codified in the Florida Statutes. After this act becomes a law, 24 its enactment and effective dates shall be noted in the Florida 25 Administrative Code or the Florida Administrative Weekly or 26 both, as appropriate. This act does not alter rulemaking 27 authority delegated by prior law, does not constitute 28 legislative preemption of or exception to any provision of law 29 governing adoption or enforcement of the rule cited, and is 30 intended to preserve the status of any cited rule as a rule 31 under chapter 120, Florida Statutes. This act does not cure any 32 rulemaking defect or preempt any challenge based on a lack of 33 authority or a violation of the legal requirements governing the 34 adoption of any rule cited. 35 Section 2. This act shall take effect upon becoming a law.
