House Comm: WD . 02/23/2011 . . . . ————————————————————————————————————————————————————————————————— ————————————————————————————————————————————————————————————————— The Committee on Budget (Montford) recommended the following: 1 Senate Amendment 2 3 Delete lines 1170 - 2226 4 and insert: 5 Section 16. (1) Any school district that receives a grant 6 of at least $75 million from a private foundation for the 7 purpose of improving the effectiveness of teachers within the 8 school district may seek an annual exemption from the State 9 Board of Education from the requirements of the amendments made 10 by this act to ss. 1012.22 and 1012.34, Florida Statutes. 11 (2) In order to receive approval from the State Board of 12 Education for an exemption under this section, a school district 13 must demonstrate to the State Board of Education that it is 14 implementing the following: 15 (a) A teacher evaluation system that uses student 16 performance as the single greatest component of the teacher’s 17 evaluation. 18 (b) A teacher compensation system that awards salary 19 increases based on sustained student performance. 20 (c) A teacher contract system that awards contracts based 21 on student performance. 22 (3) The State Board of Education shall annually renew a 23 school district’s exemption if the school district provides a 24 progress report that demonstrates that the school district 25 continues to meet the requirements of subsection (2). 26 (4) The State Board of Education shall adopt rules pursuant 27 to ss. 120.536(1) and 120.54. Florida Statutes, to establish the 28 procedures for applying for an exemption under this section. 29 Section 17. Chapter 2010-279, Laws of Florida, does not 30 apply to any rulemaking required to administer this act. 31 Section 18. The provisions of any special act or general 32 law of local application relating to contracts for instructional 33 personnel in public schools or school districts in effect on or 34 before the effective date of this act are repealed with the 35 exception of chapter 75-384, Laws of Florida.
