Florida Senate - 2011 (NP) SB 756 By Senator Joyner 18-00755-11 2011756__ 1 A bill to be entitled 2 An act relating to the City of Tampa, Hillsborough 3 County; authorizing the Division of Alcoholic 4 Beverages and Tobacco of the Department of Business 5 and Professional Regulation to issue an alcoholic 6 beverage license to the City of Tampa for use within 7 the buildings and adjoining grounds of Curtis Hixon 8 Waterfront Park and Kiley Garden Park; providing for 9 payment of the license fee; authorizing the sale of 10 alcoholic beverages for consumption within the 11 buildings and their adjoining grounds; prohibiting 12 sales for consumption off premises; providing for 13 construction of the act; authorizing the transfer and 14 providing for subsequent reversion of the license 15 under certain circumstances; providing an effective 16 date. 17 18 Be It Enacted by the Legislature of the State of Florida: 19 20 Section 1. Notwithstanding any other provision of law, the 21 Division of Alcoholic Beverages and Tobacco of the Department of 22 Business and Professional Regulation is authorized, upon 23 application, to issue an alcoholic beverage license in 24 accordance with s. 561.17, Florida Statutes, to the City of 25 Tampa, a political subdivision of the state, 306 East Jackson 26 Street, Tampa, for use within buildings located in Curtis Hixon 27 Waterfront Park, 600 North Ashley Drive, and Kiley Garden Park, 28 500 North Ashley Drive, and on adjoining grounds. The city shall 29 pay the applicable license fee provided in s. 565.02, Florida 30 Statutes. 31 Section 2. Alcoholic beverages may be sold by the licensee 32 for consumption within Curtis Hixon Waterfront Park and Kiley 33 Garden Park, including the associated buildings and adjoining 34 grounds. The license issued pursuant to this act does not permit 35 the sale of alcoholic beverages in sealed containers for 36 consumption outside the buildings and adjoining grounds. Nothing 37 in this act shall prevent the licensee from removing an opened, 38 partially consumed container of alcoholic beverage from the 39 premises. 40 Section 3. The City of Tampa may transfer the license from 41 time to time to qualified applicants who are either authorized 42 by or under contract with the city to provide food services at 43 the buildings. Upon termination of a transferee’s authorization 44 or contract, the license automatically reverts by operation of 45 law to the city. 46 Section 4. This act shall take effect upon becoming a law.
