Senator Bogdanoff moved the following:

3 Delete lines 502 - 507
4 and insert:
5 (a) “Pain-management clinic,” hereinafter referred to as
6 “clinic,” means a publicly or privately owned facility where in
7 any month a majority of patients are prescribed opioids,
8 benzodiazepines, barbiturates, or carisoprodol, for the
9 treatment of chronic nonmalignant pain. “Chronic nonmalignant
10 pain” means pain unrelated to cancer or rheumatoid arthritis
11 which persists beyond the usual course of disease or the injury
12 that is the cause of the pain or more than 90 days after
13 surgery. All privately owned pain-management clinics,
14 facilities, or offices, hereinafter referred to as “clinics,”
15 which advertise in any medium for any type of pain-management
16 services, or employ a physician who is primarily engaged in the
17 treatment of pain by prescribing or dispensing controlled
18 substance medications, must register with the department unless:
